| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 39, Education Code, is amended by adding |
|---|
| 12 | 12 | | Subchapter A to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 14 | 14 | | Sec. 39.001. LIMITATION ON IMPLEMENTATION OF CERTAIN RULES |
|---|
| 15 | 15 | | REGARDING PUBLIC SCHOOL ACCOUNTABILITY. Notwithstanding any other |
|---|
| 16 | 16 | | law, a rule adopted by the commissioner or the agency that affects |
|---|
| 17 | 17 | | methods or procedures for administering provisions of this chapter |
|---|
| 18 | 18 | | may not be implemented before the second school year after the |
|---|
| 19 | 19 | | school year the rule is adopted unless the commissioner or the |
|---|
| 20 | 20 | | agency is required by law to adopt and implement such a rule in a |
|---|
| 21 | 21 | | shorter period. |
|---|
| 22 | 22 | | SECTION 2. Section 39.001, Education Code, as added by this |
|---|
| 23 | 23 | | Act, applies only to a rule adopted on or after the effective date |
|---|
| 24 | 24 | | of this Act. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
