| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 102.0212, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 102.0212. COURT COSTS ON CONVICTION: LOCAL GOVERNMENT |
|---|
| 13 | 13 | | CODE. A person convicted of an offense shall pay the following |
|---|
| 14 | 14 | | under the Local Government Code, in addition to all other costs: |
|---|
| 15 | 15 | | (1) court costs on conviction of a felony (Sec. |
|---|
| 16 | 16 | | 133.102, Local Government Code) . . . $133; |
|---|
| 17 | 17 | | (2) court costs on conviction of a Class A or Class B |
|---|
| 18 | 18 | | misdemeanor (Sec. 133.102, Local Government Code) . . . $83; |

| 19 | 19 | | (3) court costs on conviction of a nonjailable |
|---|
| 20 | 20 | | misdemeanor offense, including a criminal violation of a municipal |
|---|
| 21 | 21 | | ordinance, other than a conviction of an offense relating to a |
|---|
| 22 | 22 | | pedestrian or the parking of a motor vehicle (Sec. 133.102, Local |
|---|
| 23 | 23 | | Government Code) . . . $40; |

| 35 | 35 | | SECTION 2. Section 133.003, Local Government Code, is |

| 36 | 36 | | amended to read as follows: |

| 37 | 37 | | Sec. 133.003. CRIMINAL FEES. This chapter applies to the |

| 38 | 38 | | following criminal fees: |
|---|
| 39 | 39 | | (1) the consolidated fee imposed under Section |
|---|
| 40 | 40 | | 133.102; |

| 41 | 41 | | (2) [the time payment fee imposed under Section |

| 43 | 43 | | [(3)] fees for services of peace officers employed by |

| 45 | 45 | | Procedure, and forwarded to the comptroller as provided by Section |

| 48 | 48 | | statutory county courts under Section 51.702, Government Code, and |

|---|
| 51 | 51 | | county courts under Section 51.703, Government Code, and deposited |
|---|

| 53 | 53 | | (5) [(6)] the administrative fee for failure to appear |
|---|
| 54 | 54 | | or failure to pay or satisfy a judgment imposed under Section |
|---|
| 55 | 55 | | 706.006, Transportation Code; |

| 56 | 56 | | (6) [(7)] fines on conviction imposed under Section |
|---|
| 57 | 57 | | 621.506(g), Transportation Code; |
|---|
| 58 | 58 | | (7) [(8)] the fee imposed under Article 102.0045, Code |
|---|
| 59 | 59 | | of Criminal Procedure; |
|---|
| 60 | 60 | | (8) [(9)] the cost on conviction imposed under Section |
|---|
| 61 | 61 | | 133.105 and deposited in the judicial fund; and |
|---|
| 62 | 62 | | (9) [(10)] the cost on conviction imposed under |
|---|
| 63 | 63 | | Section 133.107. |
|---|
| 64 | 64 | | SECTION 3. Section 133.103, Local Government Code, is |
|---|
| 65 | 65 | | repealed. |
|---|
| 66 | 66 | | SECTION 4. The repeal by this Act of Section 133.103, Local |
|---|
| 67 | 67 | | Government Code, does not apply to an offense committed before the |
|---|
| 68 | 68 | | effective date of this Act. An offense committed before the |
|---|
| 69 | 69 | | effective date of this Act is governed by the law as it existed on |
|---|
| 70 | 70 | | the date the offense was committed, and the former law is continued |
|---|
| 71 | 71 | | in effect for that purpose. For purposes of this section, an |
|---|
| 72 | 72 | | offense was committed before the effective date of this Act if any |
|---|
| 73 | 73 | | element of the offense occurred before that date. |
|---|
| 74 | 74 | | SECTION 5. This Act takes effect September 1, 2017. |
