8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Sections 521.457(e) and (f-1), Transportation | |
10 | 10 | Code, are amended to read as follows: | |
11 | 11 | (e) Except as provided by Subsections [(f),] (f-1)[,] and | |
12 | 12 | (f-2), an offense under this section is a Class C misdemeanor. | |
13 | 13 | (f-1) If it is shown on the trial of an offense under this | |
14 | 14 | section that at the time of the offense, the license of the person | |
15 | 15 | was [has previously been] suspended as the result of an offense | |
16 | 16 | involving the operation of a motor vehicle while intoxicated, the | |
17 | 17 | offense is a Class B misdemeanor. | |
18 | 18 | SECTION 2. Section 521.457(f), Transportation Code, is | |
19 | 19 | repealed. | |
20 | 20 | SECTION 3. The change in law made by this Act applies only | |
21 | 21 | to an offense committed on or after the effective date of this Act. | |
22 | 22 | An offense committed before the effective date of this Act is | |
23 | 23 | governed by the law in effect on the date the offense was committed, | |
24 | 24 | and the former law is continued in effect for that purpose. For | |
25 | 25 | purposes of this section, an offense was committed before the | |
26 | 26 | effective date of this Act if any element of the offense occurred | |
27 | 27 | before that date. | |
28 | 28 | SECTION 4. This Act takes effect September 1, 2017. |
