55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense of driving while license invalid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 521.457(e) and (f-1), Transportation
1010 Code, are amended to read as follows:
1111 (e) Except as provided by Subsections [(f),] (f-1)[,] and
1212 (f-2), an offense under this section is a Class C misdemeanor.
1313 (f-1) If it is shown on the trial of an offense under this
1414 section that at the time of the offense, the license of the person
1515 was [has previously been] suspended as the result of an offense
1616 involving the operation of a motor vehicle while intoxicated, the
1717 offense is a Class B misdemeanor.
1818 SECTION 2. Section 521.457(f), Transportation Code, is
1919 repealed.
2020 SECTION 3. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 4. This Act takes effect September 1, 2017.
