6	6	AN ACT
7	7	relating to a system of care framework for certain minors receiving
8	8	mental health services.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 531.251, Government Code, is reenacted
11	11	to read as follows:
12	12	Sec. 531.251. TEXAS SYSTEM OF CARE FRAMEWORK. (a) In this
13	13	section:
14	14	(1) "Minor" means an individual younger than 18 years
15	15	of age.
16	16	(2) "Serious emotional disturbance" means a mental,
17	17	behavioral, or emotional disorder of sufficient duration to result
18	18	in functional impairment that substantially interferes with or
19	19	limits a person's role or ability to function in family, school, or
20	20	community activities.
21	21	(3) "System of care framework" means a framework for
22	22	collaboration among state agencies, minors who have a serious
23	23	emotional disturbance or are at risk of developing a serious
24	24	emotional disturbance, and the families of those minors that
25	25	improves access to services and delivers effective community-based
26	26	services that are family-driven, youth- or young adult-guided, and
27	27	culturally and linguistically competent.
28	28	(b) The commission shall implement a system of care
29	29	framework to develop local mental health systems of care in
30	30	communities for minors who are receiving residential mental health
31	31	services and supports or inpatient mental health hospitalization,
32	32	have or are at risk of developing a serious emotional disturbance,
33	33	or are at risk of being removed from the minor's home and placed in a
34	34	more restrictive environment to receive mental health services and
35	35	supports, including an inpatient mental health hospital, a
36	36	residential treatment facility, or a facility or program operated
37	37	by the Department of Family and Protective Services or an agency
38	38	that is part of the juvenile justice system.
39	39	(c) The commission shall:
40	40	(1) maintain a comprehensive plan for the delivery of
41	41	mental health services and supports to a minor and a minor's family
42	42	using a system of care framework, including best practices in the
43	43	financing, administration, governance, and delivery of those
44	44	services;
45	45	(2) enter memoranda of understanding with the
46	46	Department of State Health Services, the Department of Family and
47	47	Protective Services, the Texas Education Agency, the Texas Juvenile
48	48	Justice Department, and the Texas Correctional Office on Offenders
49	49	with Medical or Mental Impairments that specify the roles and
50	50	responsibilities of each agency in implementing the comprehensive
51	51	plan described by Subdivision (1);
52	52	(3) identify appropriate local, state, and federal
53	53	funding sources to finance infrastructure and mental health
54	54	services and supports needed to support state and local system of
55	55	care framework efforts;
56	56	(4) develop an evaluation system to measure
57	57	cross-system performance and outcomes of state and local system of
58	58	care framework efforts; and
59	59	(5) in implementing the provisions of this section,
60	60	consult with stakeholders, including:
61	61	(A) minors who have or are at risk of developing a
62	62	serious emotional disturbance or young adults who received mental
63	63	health services and supports as a minor with or at risk of
64	64	developing a serious emotional disturbance; and
65	65	(B) family members of those minors or young
66	66	adults.
67	67	SECTION 2. As soon as practicable after the effective date
68	68	of this Act, the Health and Human Services Commission shall
69	69	implement the system of care framework and perform other actions
70	70	corresponding with the system of care framework as required by
71	71	Section 531.251, Government Code, as reenacted by this Act.
72	72	SECTION 3. This Act takes effect immediately if it receives
73	73	a vote of two-thirds of all the members elected to each house, as
74	74	provided by Section 39, Article III, Texas Constitution. If this
75	75	Act does not receive the vote necessary for immediate effect, this
76	76	Act takes effect September 1, 2017.
