55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a county to use county revenue or incur
88 county debt for certain public works projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 4, Local Government Code, is
1111 amended by adding Chapter 120 to read as follows:
1212 CHAPTER 120. ELECTION REQUIRED TO FUND CERTAIN PUBLIC WORKS
1313 PROJECTS
1414 Sec. 120.001. DEFINITIONS. In this chapter:
1515 (1) "Project cost" is the total cost required to
1616 complete a public works project, including all costs related to:
1717 (A) the planning and development of the project;
1818 (B) the acquisition of real property for the
1919 project; and
2020 (C) the construction, alteration, repair,
2121 equipping, and furnishing of the project.
2222 (2) "Public works project" means:
2323 (A) the construction, alteration, repair,
2424 equipping, or furnishing of a public building or structure; or
2525 (B) the construction, alteration, or repair of
2626 any other public work, including a road, sewer or water line,
2727 swimming pool, or other improvement to real property.
2828 Sec. 120.002. ELECTION REQUIREMENT FOR CERTAIN PUBLIC WORKS
2929 PROJECTS. A county may not fund, in whole or in part, a public works
3030 project with county revenue or debt if the project cost is $50
3131 million or more unless the funding is approved by a majority of the
3232 voters of the county at an election held for that purpose.
3333 SECTION 2. The change in law made by this Act applies only
3434 to a public works project as defined by Section 120.001, Local
3535 Government Code, as added by this Act, for which:
3636 (1) a contract for the project has not been executed on
3737 the effective date of this Act; or
3838 (2) if no contract for the project will be executed,
3939 the actual construction, alteration, or repair of the project has
4040 not begun on the effective date of this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2017.
