| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Subchapter C, Chapter 341, Health and Safety |

| 15 | 9 | | Code, is amended by adding Section 341.0391 to read as follows: |
|---|
| 16 | 10 | | Sec. 341.0391. COUNTY PILOT PROGRAM FOR WASTEWATER REUSE. |
|---|
| 17 | 11 | | (a) This section applies only to a county with a population of more |
|---|
| 18 | 12 | | than 3.3 million. |
|---|
| 19 | 13 | | (b) A county may implement a pilot program to reuse any form |
|---|
| 20 | 14 | | of wastewater at a county facility for subsurface irrigation and |
|---|
| 21 | 15 | | toilet and urinal flushing. The program must require the wastewater |
|---|
| 22 | 16 | | to be treated at the facility before reuse. |
|---|
| 23 | 17 | | (c) The commission may adopt rules to ensure that a program |
|---|
| 24 | 18 | | implemented under this section does not create a nuisance and does |
|---|
| 25 | 19 | | not threaten human health or damage the quality of surface water and |
|---|
| 26 | 20 | | groundwater in this state. |

| 27 | 21 | | SECTION 2. This Act takes effect September 1, 2017. |
