| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 533.00255(c), Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (c) A managed care organization that contracts with the |
|---|
| 14 | 14 | | commission under this chapter shall: |
|---|
| 15 | 15 | | (1) develop a network of public and private providers |
|---|
| 16 | 16 | | of behavioral health services and ensure adults with serious mental |
|---|
| 17 | 17 | | illness and children with serious emotional disturbance have access |
|---|
| 18 | 18 | | to a comprehensive array of services; and |
|---|
| 19 | 19 | | (2) if the managed care organization intends to |
|---|
| 20 | 20 | | contract with an integrated provider site for the provision of both |
|---|
| 21 | 21 | | behavioral health services and physical health services, offer the |
|---|
| 22 | 22 | | integrated provider site the option of entering into a single |
|---|
| 23 | 23 | | contract with the managed care organization to provide those |
|---|
| 24 | 24 | | services, even if the managed care organization contracts with a |
|---|
| 25 | 25 | | behavioral health organization to coordinate the provision of |
|---|
| 26 | 26 | | behavioral health services for the managed care organization. |
|---|
| 27 | 27 | | SECTION 2. Section 533.00255(c), Government Code, as |
|---|
| 28 | 28 | | amended by this Act, applies to a contract entered into or renewed |
|---|
| 29 | 29 | | on or after the effective date of this Act. |
|---|
| 30 | 30 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 31 | 31 | | a state agency determines that a waiver or authorization from a |
|---|
| 32 | 32 | | federal agency is necessary for implementation of that provision, |
|---|
| 33 | 33 | | the agency affected by the provision shall request the waiver or |
|---|
| 34 | 34 | | authorization and may delay implementing that provision until the |
|---|
| 35 | 35 | | waiver or authorization is granted. |
|---|
| 36 | 36 | | SECTION 4. This Act takes effect September 1, 2017. |
