| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 821.023(e), Health and Safety Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (e) After a court finds that an animal's owner has cruelly | |
| 13 | 13 | treated the animal, the court shall order the owner to pay all | |
| 14 | 14 | [court] costs to the appropriate party, including: | |
| 15 | 15 | (1) the administrative costs of: | |
| 16 | 16 | (A) investigation; | |
| 17 | 17 | (B) expert witnesses; and | |
| 18 | 18 | (C) conducting any public sale ordered by the | |
| 19 | 19 | court; [and] | |
| 20 | 20 | (2) the costs incurred by a municipal or county animal | |
| 21 | 21 | shelter or a nonprofit animal welfare organization in: | |
| 22 | 22 | (A) housing and caring for the animal during its | |
| 23 | 23 | impoundment; and | |
| 24 | 24 | (B) humanely destroying the animal if | |
| 25 | 25 | destruction is ordered by the court; and | |
| 26 | 26 | (3) any costs incurred by a landlord or landowner in | |
| 27 | 27 | housing and caring for an animal unreasonably abandoned by a tenant | |
| 28 | 28 | after the tenant's eviction. | |
| 29 | 29 | SECTION 2. The change in law made by this Act applies to | |
| 30 | 30 | costs incurred by a landlord or landowner on or after the effective | |
| 31 | 31 | date of this Act. | |
| 32 | 32 | SECTION 3. This Act takes effect September 1, 2017. |
