55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the payment of costs for a cruelly treated animal
88 abandoned by a tenant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 821.023(e), Health and Safety Code, is
1111 amended to read as follows:
1212 (e) After a court finds that an animal's owner has cruelly
1313 treated the animal, the court shall order the owner to pay all
1414 [court] costs to the appropriate party, including:
1515 (1) the administrative costs of:
1616 (A) investigation;
1717 (B) expert witnesses; and
1818 (C) conducting any public sale ordered by the
1919 court; [and]
2020 (2) the costs incurred by a municipal or county animal
2121 shelter or a nonprofit animal welfare organization in:
2222 (A) housing and caring for the animal during its
2323 impoundment; and
2424 (B) humanely destroying the animal if
2525 destruction is ordered by the court; and
2626 (3) any costs incurred by a landlord or landowner in
2727 housing and caring for an animal unreasonably abandoned by a tenant
2828 after the tenant's eviction.
2929 SECTION 2. The change in law made by this Act applies to
3030 costs incurred by a landlord or landowner on or after the effective
3131 date of this Act.
3232 SECTION 3. This Act takes effect September 1, 2017.
