| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 547.305, Transportation Code, is amended |
|---|
| 15 | 9 | | by adding Subsections (e-1) and (e-2) and amending Subsection (f) |
|---|
| 16 | 10 | | to read as follows: |
|---|
| 17 | 11 | | (e-1) A security patrol vehicle may only be equipped with |
|---|
| 18 | 12 | | green, amber, or white lights. |
|---|
| 19 | 13 | | (e-2) A motor vehicle is equipped with a lamp or |
|---|
| 20 | 14 | | illuminating device under this section regardless of whether the |
|---|
| 21 | 15 | | lamp or illuminating device is: |
|---|
| 22 | 16 | | (1) attached to the motor vehicle temporarily or |
|---|
| 23 | 17 | | permanently; or |
|---|
| 24 | 18 | | (2) activated. |
|---|
| 25 | 19 | | (f) In this section: |
|---|
| 26 | 20 | | (1) "Security patrol vehicle" means a motor vehicle |
|---|
| 27 | 21 | | being used for the purpose of providing security services by: |
|---|
| 28 | 22 | | (A) a guard company described by Section |
|---|
| 29 | 23 | | 1702.108, Occupations Code; or |
|---|
| 30 | 24 | | (B) a security officer as defined by Section |
|---|
| 31 | 25 | | 1702.002, Occupations Code. |
|---|
| 32 | 26 | | (2) "Tow ["tow] truck" means a motor vehicle or |
|---|
| 33 | 27 | | mechanical device that is adapted or used to tow, winch, or move a |
|---|
| 34 | 28 | | disabled vehicle. |
|---|
| 35 | 29 | | SECTION 2. This Act takes effect September 1, 2018. |
