66 AN ACT
77 relating to the installation and inspection of fire sprinkler
88 protection systems; authorizing fees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1301.3565, Occupations Code, is amended
1111 by adding Subsection (g) to read as follows:
1212 (g) A certified fire inspector who is employed or appointed
1313 by a political subdivision or this state may inspect or review plans
1414 only for the sprinkler portion of a multipurpose residential fire
1515 sprinkler installation, repair, or replacement.
1616 SECTION 2. Section 1301.551, Occupations Code, is amended
1717 by amending Subsection (i) and adding Subsection (k) to read as
1818 follows:
1919 (i) Notwithstanding any other provision of state law,
2020 except as provided by Subsection (k), after January 1, 2009, a
2121 municipality may not enact an ordinance, bylaw, order, building
2222 code, or rule requiring the installation of a multipurpose
2323 residential fire protection sprinkler system or any other fire
2424 sprinkler protection system in a new or existing one- or two-family
2525 dwelling. A municipality may adopt an ordinance, bylaw, order, or
2626 rule allowing a multipurpose residential fire protection sprinkler
2727 specialist [or other contractor] to offer, for a fee, the
2828 installation of a fire sprinkler protection system in a new one- or
2929 two-family dwelling.
3030 (k) A municipality with a population of less than 50,000 may
3131 enact an ordinance, bylaw, order, building code, or rule requiring
3232 the installation of a multipurpose residential fire protection
3333 sprinkler system or any other fire sprinkler protection system in a
3434 new one- or two-family dwelling only if the municipality holds an
3535 election called for the purpose of authorizing the municipality to
3636 enact the requirement and a majority of the voters approve the
3737 proposition. A municipality described by this subsection that
3838 enacts the requirement as provided by this subsection may not
3939 impose an inspection fee for inspection of a multipurpose
4040 residential fire protection sprinkler system but may impose an
4141 annual inspection fee not to exceed $25 for inspection of any other
4242 fire sprinkler protection system.
4343 SECTION 3. This Act takes effect September 1, 2017.
