114 AN ACT
125 relating to the establishment of an advisory committee for the
136 TexNet seismic monitoring program.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Chapter 67, Education Code, is amended by adding
169 Subchapter E to read as follows:
1710 SUBCHAPTER E. THE UNIVERSITY OF TEXAS BUREAU OF ECONOMIC GEOLOGY
1811 Sec. 67.71. DEFINITION. In this subchapter, "bureau" means

2013 Sec. 67.72. TEXNET TECHNICAL ADVISORY COMMITTEE. (a) In
2114 this section, "program" means the TexNet seismic monitoring program
2215 administered by the bureau.
2316 (b) The TexNet Technical Advisory Committee is established
2417 as an advisory committee within the bureau.
2518 (c) The advisory committee consists of nine members
2619 appointed by the governor, including:
2720 (1) one representative of the Railroad Commission of
2821 Texas who specializes in seismology, geomechanical engineering,
2922 reservoir engineering, or another related field recommended to the
3023 governor by the executive director of the Railroad Commission of
3124 Texas; and
3225 (2) at least three representatives from the oil and
3326 gas industry, not to include the representative appointed under
3427 Subdivision (1).
3528 (d) The governor shall designate a member of the advisory
3629 committee as the chair of the advisory committee to serve in that
3730 capacity at the pleasure of the governor.
3831 (e) A person affiliated with the bureau or under contract
3932 for services with the bureau may not serve as a voting member of the
4033 advisory committee.
4134 (f) The director of the bureau shall serve, ex officio, as a
4235 nonvoting member of the advisory committee.
4336 (g) The advisory committee shall:
4437 (1) in coordination with the bureau, develop
4538 recommendations for a program of work to assist the program and any
4639 research efforts affiliated with the program in accomplishing the
4740 goals of the program, including recommendations regarding:
4841 (A) the acquisition and deployment of equipment;
4942 (B) contracting with vendors;
5043 (C) determining the scope of research programs
5144 associated with the program; and
5245 (D) determining the scope of any use of funds
5346 appropriated by the legislature for the program or associated
5447 research;
5548 (2) review and approve or reject expenditures made in
5649 connection with the program;
5750 (3) prepare and approve an annual budget for the use of
5851 any funds appropriated for the program by the legislature;
5952 (4) provide oversight and input on the acquisition,
6053 deployment, and operation of new and existing program equipment;
6154 (5) ensure that there is a monthly transmission of the
6255 data collected by seismic equipment operated under the program to
6356 the Incorporated Research Institutions for Seismology database;
6457 and
6558 (6) solicit from the bureau quarterly updates
6659 regarding the progress of the program, expenditures made in
6760 connection with the program, and any other information related to
6861 the program that the advisory committee finds necessary.
6962 (h) Not later than December 1 of each even-numbered year,
7063 the advisory committee shall prepare and submit to the governor,
7164 the lieutenant governor, and the speaker of the house of
7265 representatives a report that includes:
7366 (1) a review of the use of any funds appropriated for
7467 the program by the legislature;
7568 (2) a complete listing and accounting of all research
7669 funded through the program, including:
7770 (A) a list of contractors employed under the
7871 program;
7972 (B) an itemized budget for each program element;
8073 and
8174 (C) a list of the geographic coverage of the
8275 program; and
8376 (3) recommendations related to the ongoing operations
8477 and requirements of the program.
8578 (i) This section expires September 1, 2019.
8679 SECTION 2. This Act takes effect September 1, 2017.
