11	4		AN ACT
12	5		relating to the establishment of an advisory committee for the
13	6		TexNet seismic monitoring program.
14	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	8		SECTION 1. Chapter 67, Education Code, is amended by adding
16	9		Subchapter E to read as follows:
17	10		SUBCHAPTER E. THE UNIVERSITY OF TEXAS BUREAU OF ECONOMIC GEOLOGY
18	11		Sec. 67.71. DEFINITION. In this subchapter, "bureau" means
19	12		The University of Texas Bureau of Economic Geology.
20	13		Sec. 67.72. TEXNET TECHNICAL ADVISORY COMMITTEE. (a) In
21	14		this section, "program" means the TexNet seismic monitoring program
22	15		administered by the bureau.
23	16		(b) The TexNet Technical Advisory Committee is established
24	17		as an advisory committee within the bureau.
25	18		(c) The advisory committee consists of nine members
26	19		appointed by the governor, including:
27	20		(1) one representative of the Railroad Commission of
28	21		Texas who specializes in seismology, geomechanical engineering,
29	22		reservoir engineering, or another related field recommended to the
30	23		governor by the executive director of the Railroad Commission of
31	24		Texas; and
32	25		(2) at least three representatives from the oil and
33	26		gas industry, not to include the representative appointed under
34	27		Subdivision (1).
35	28		(d) The governor shall designate a member of the advisory
36	29		committee as the chair of the advisory committee to serve in that
37	30		capacity at the pleasure of the governor.
38	31		(e) A person affiliated with the bureau or under contract
39	32		for services with the bureau may not serve as a voting member of the
40	33		advisory committee.
41	34		(f) The director of the bureau shall serve, ex officio, as a
42	35		nonvoting member of the advisory committee.
43	36		(g) The advisory committee shall:
44	37		(1) in coordination with the bureau, develop
45	38		recommendations for a program of work to assist the program and any
46	39		research efforts affiliated with the program in accomplishing the
47	40		goals of the program, including recommendations regarding:
48	41		(A) the acquisition and deployment of equipment;
49	42		(B) contracting with vendors;
50	43		(C) determining the scope of research programs
51	44		associated with the program; and
52	45		(D) determining the scope of any use of funds
53	46		appropriated by the legislature for the program or associated
54	47		research;
55	48		(2) review and approve or reject expenditures made in
56	49		connection with the program;
57	50		(3) prepare and approve an annual budget for the use of
58	51		any funds appropriated for the program by the legislature;
59	52		(4) provide oversight and input on the acquisition,
60	53		deployment, and operation of new and existing program equipment;
61	54		(5) ensure that there is a monthly transmission of the
62	55		data collected by seismic equipment operated under the program to
63	56		the Incorporated Research Institutions for Seismology database;
64	57		and
65	58		(6) solicit from the bureau quarterly updates
66	59		regarding the progress of the program, expenditures made in
67	60		connection with the program, and any other information related to
68	61		the program that the advisory committee finds necessary.
69	62		(h) Not later than December 1 of each even-numbered year,
70	63		the advisory committee shall prepare and submit to the governor,
71	64		the lieutenant governor, and the speaker of the house of
72	65		representatives a report that includes:
73	66		(1) a review of the use of any funds appropriated for
74	67		the program by the legislature;
75	68		(2) a complete listing and accounting of all research
76	69		funded through the program, including:
77	70		(A) a list of contractors employed under the
78	71		program;
79	72		(B) an itemized budget for each program element;
80	73		and
81	74		(C) a list of the geographic coverage of the
82	75		program; and
83	76		(3) recommendations related to the ongoing operations
84	77		and requirements of the program.
85	78		(i) This section expires September 1, 2019.
86	79		SECTION 2. This Act takes effect September 1, 2017.
