88 AN ACT
99 relating to establishing the Texas Peace Officers' Memorial
1010 Ceremony Committee to recognize and honor peace officers who were
1111 killed in the line of duty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Chapter 3105, Government Code, is
1414 amended to read as follows:
1515 CHAPTER 3105. TEXAS PEACE OFFICERS' MEMORIAL MONUMENT AND CEREMONY
1616 SECTION 2. Section 3105.002, Government Code, is amended by
1717 adding Subdivision (2-a) to read as follows:
1818 (2-a) "Committee" means the Texas Peace Officers'
1919 Memorial Ceremony Committee.
2020 SECTION 3. Section 3105.005(c), Government Code, is amended
2121 to read as follows:
2222 (c) Money in the account may be used only for the purposes
2323 prescribed by Section 3105.004 [this chapter].
2424 SECTION 4. Chapter 3105, Government Code, is amended by
2525 adding Sections 3105.006 and 3105.007 to read as follows:
2626 Sec. 3105.006. TEXAS PEACE OFFICERS' MEMORIAL CEREMONY
2727 COMMITTEE. (a) The committee is established to plan, oversee, and
2828 facilitate annual ceremonies recognizing and honoring peace
2929 officers of this state who were killed in the line of duty.
3030 (b) The committee consists of the following members:
3131 (1) a president, or the president's designee, of any
3232 law enforcement organization that:
3333 (A) provides full service legal and political
3434 representation to law enforcement officers of this state;
3535 (B) has at least 10,000 members paying dues, as
3636 provided by the organization's Internal Revenue Service Form 990
3737 for the previous reporting period;
3838 (C) has complied with all filing requirements of
3939 the Internal Revenue Service, the United States Department of
4040 Labor, and the secretary of state; and
4141 (D) has an elected board of directors;
4242 (2) a surviving spouse of a peace officer killed in the
4343 line of duty selected by the chapters of the Concerns of Police
4444 Survivors of this state; and
4545 (3) the following nonvoting members or designees of
4646 the members:
4747 (A) the governor;
4848 (B) the lieutenant governor;
4949 (C) the speaker of the house of representatives;
5050 (D) the attorney general;
5151 (E) the director of the Department of Public
5252 Safety;
5353 (F) the executive director of the board; and
5454 (G) the executive director of the commission.
5555 Sec. 3105.007. TEXAS PEACE OFFICERS' MEMORIAL CEREMONY.
5656 (a) The committee shall meet as necessary to plan and coordinate an
5757 annual memorial ceremony on the Capitol grounds to honor Texas
5858 peace officers who were killed in the line of duty.
5959 (b) The committee shall hold the ceremony on a date selected
6060 by the committee during the week in which May 8 occurs.
6161 (c) The ceremony may be funded by public or private money.
6262 (d) Each odd-numbered year, the ceremony must include:
6363 (1) a parade of law enforcement color guards and
6464 personnel ending at the Capitol; and
6565 (2) a ceremony held during a joint session of the
6666 legislature on the floor of the house of representatives, if
6767 possible.
6868 (e) During the ceremony under this section, the name of each
6969 peace officer who is being added to the monument that year must be
7070 read and the surviving family members of the peace officer must be
7171 recognized.
7272 SECTION 5. This Act takes effect September 1, 2017.
