| 8 | 8 | | voting by personal appearance. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.004(d), Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) The [If early voting by personal appearance is required |
|---|
| 13 | 13 | | to be conducted for extended hours under Section 85.005(c) or for |
|---|
| 14 | 14 | | weekend hours under Section 85.006(e), the] registrar's office |
|---|
| 15 | 15 | | shall remain open for providing voter registration information |
|---|
| 16 | 16 | | during the [extended hours or weekend] hours that the main early |
|---|
| 17 | 17 | | voting polling place is open for voting. |
|---|
| 18 | 18 | | SECTION 2. Sections 85.005(c) and (d), Election Code, are |
|---|
| 19 | 19 | | amended to read as follows: |
|---|
| 20 | 20 | | (c) Voting [In a county with a population of 100,000 or |
|---|
| 21 | 21 | | more, the voting] in a primary election or the general election for |
|---|
| 22 | 22 | | state and county officers shall be conducted at the main early |
|---|
| 23 | 23 | | voting polling place from 7 a.m. until 7 p.m. [for at least 12 |
|---|
| 24 | 24 | | hours] on each weekday [of the last week] of the early voting |
|---|
| 25 | 25 | | period[, and the voting in a special election ordered by the |
|---|
| 26 | 26 | | governor shall be conducted at the main early voting polling place |
|---|
| 27 | 27 | | for at least 12 hours on each of the last two days of the early |
|---|
| 28 | 28 | | voting period. Voting shall be conducted in accordance with this |
|---|
| 29 | 29 | | subsection in those elections in a county with a population under |
|---|
| 30 | 30 | | 100,000 on receipt by the early voting clerk of a written request |
|---|
| 31 | 31 | | for the extended hours submitted by at least 15 registered voters of |
|---|
| 32 | 32 | | the county. The request must be submitted in time to enable |
|---|
| 33 | 33 | | compliance with Section 85.067]. |
|---|
| 34 | 34 | | (d) In an election ordered by a city, early voting by |
|---|
| 35 | 35 | | personal appearance at the main early voting polling place shall be |
|---|
| 36 | 36 | | conducted from 7 a.m. until 7 p.m. [for at least 12 hours: |
|---|
| 37 | 37 | | [(1) on one weekday, if the early voting period |
|---|
| 38 | 38 | | consists of less than six weekdays; or |
|---|
| 39 | 39 | | [(2) on two weekdays, if the early voting period |
|---|
| 40 | 40 | | consists of six or more weekdays.] |
|---|
| 41 | 41 | | SECTION 3. Section 85.006(e), Election Code, is amended to |
|---|
| 42 | 42 | | read as follows: |
|---|
| 43 | 43 | | (e) In a primary election or the general election for state |
|---|
| 44 | 44 | | and county officers [in a county with a population of 100,000 or |
|---|
| 45 | 45 | | more], the early voting clerk shall order personal appearance |
|---|
| 46 | 46 | | voting at the main early voting polling place to be conducted from 7 |
|---|
| 47 | 47 | | a.m. until 7 p.m. [for at least 12 hours] on the last Saturday and |
|---|
| 48 | 48 | | for at least five hours on the last Sunday of the early voting |
|---|
| 49 | 49 | | period. [The early voting clerk shall order voting to be conducted |
|---|
| 50 | 50 | | at those times in those elections in a county with a population |
|---|
| 51 | 51 | | under 100,000 on receipt of a written request for those hours |
|---|
| 52 | 52 | | submitted by at least 15 registered voters of the county. The |
|---|
| 53 | 53 | | request must be submitted in time to enable compliance with Section |
|---|
| 54 | 54 | | 85.007.] This subsection supersedes any provision of this |
|---|
| 55 | 55 | | subchapter to the extent of any conflict. |
|---|
| 56 | 56 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 57 | 57 | | an election for which early voting begins on or after September 1, |
|---|
| 58 | 58 | | 2017. |
|---|
| 59 | 59 | | SECTION 5. This Act takes effect September 1, 2017. |
