99 relating to the identification of breeder deer by use of microchip
1010 implants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 43.3561, Parks and Wildlife Code, is
1313 amended by amending Subsection (a) and adding Subsections (a-1) and
1414 (a-2) to read as follows:
1515 (a) Not later than March 31 of the year following the year in
1616 which a [the] breeder deer is born, the [a] breeder deer held in a
1717 permitted deer breeding facility must be identified by:
1818 (1) placing on each breeder deer possessed by the deer
1919 breeder a single, reasonably visible, durable identification tag
2020 bearing an alphanumeric number of not more than four characters
2121 assigned by the department to the breeding facility in which the
2222 breeder deer was born and unique to that breeder deer; or
2323 (2) implanting in the breeder deer a microchip that is
2424 recognized by the United States Department of Agriculture for the
2525 identification of animals.
2626 (a-1) A deer breeder is not required to remove the durable
2727 identification tag or microchip for any purpose but may remove the
2828 tag or microchip and replace the tag or microchip immediately to
2929 meet the requirements of this section.
3030 (a-2) A deer breeder that uses a microchip for the
3131 identification of breeder deer shall make available a microchip
3232 reader for use by personnel of the department and the Texas Animal
3333 Health Commission.
3434 SECTION 2. Sections 43.357(a-1) and (b), Parks and Wildlife
3535 Code, are amended to read as follows:
3636 (a-1) A deer breeder, a deer breeder's authorized agent, or
3737 an assistant who is not a permittee under this subchapter but is
3838 acting under the direction of a deer breeder or a deer breeder's
3939 authorized agent may capture a breeder deer held in a permitted
4040 facility for:
4141 (1) removal from an enclosure;
4242 (2) veterinary treatment;
4343 (3) tagging or implanting a microchip;
4444 (4) euthanasia for the purpose of:
4545 (A) humane dispatch of the breeder deer; or
4646 (B) the conduct of a test for a reportable
4747 disease as required by law; or
4848 (5) any other purpose required or allowed by law.
4949 (b) The commission may make regulations governing:
5050 (1) the possession of breeder deer held under the
5151 authority of this subchapter;
5252 (2) the recapture of lawfully possessed breeder deer
5353 that have escaped from the facility of a deer breeder;
5454 (3) permit applications and fees;
5555 (4) reporting requirements;
5656 (5) procedures and requirements for the purchase,
5757 transfer, sale, or shipment of breeder deer;
5858 (6) the endorsement of a deer breeder facility by a
5959 certified wildlife biologist;
6060 (7) the number of breeder deer that a deer breeder may
6161 possess; [and]
6262 (8) the dates for which a deer breeder permit is valid;
6363 and
6464 (9) the use of microchip implants for identifying
6565 breeder deer under this section.
6666 SECTION 3. This Act takes effect September 1, 2017.
