| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 45, Family Code, is amended |
|---|
| 11 | 11 | | by adding Section 45.108 to read as follows: |
|---|
| 12 | 12 | | Sec. 45.108. CHANGE OF NAME AND VITAL STATISTICS |
|---|
| 13 | 13 | | INFORMATION. (a) Subject to the eligibility requirements for a |
|---|
| 14 | 14 | | name change under Section 45.103, a court shall order a change of |
|---|
| 15 | 15 | | name under this subchapter for a petitioner whose petition is |
|---|
| 16 | 16 | | accompanied by a sworn affidavit of a licensed physician stating |
|---|
| 17 | 17 | | the petitioner identifies as a gender other than the gender |
|---|
| 18 | 18 | | indicated on the petitioner's driver's license, birth certificate, |
|---|
| 19 | 19 | | or other official document. |
|---|
| 20 | 20 | | (b) A court that orders a change of name for a petitioner |
|---|
| 21 | 21 | | under this section shall simultaneously order: |
|---|
| 22 | 22 | | (1) the Department of Public Safety, as soon as |
|---|
| 23 | 23 | | practicable, to change the petitioner's name and gender on the |
|---|
| 24 | 24 | | petitioner's driver's license and other identification documents |
|---|
| 25 | 25 | | under the department's control; and |
|---|
| 26 | 26 | | (2) the vital statistics unit of the Department of |
|---|
| 27 | 27 | | State Health Services, on receipt of a licensed physician's sworn |
|---|
| 28 | 28 | | affidavit that the petitioner identifies as a gender other than the |
|---|
| 29 | 29 | | gender indicated on the petitioner's birth certificate, to amend |
|---|
| 30 | 30 | | the petitioner's birth certificate in the manner provided by |
|---|
| 31 | 31 | | Section 192.011, Health and Safety Code, to reflect the |
|---|
| 32 | 32 | | petitioner's true gender. |
|---|
| 33 | 33 | | (c) This section may not be construed to require a surgical |
|---|
| 34 | 34 | | procedure as a prerequisite for a court order under Subsection (a) |
|---|
| 35 | 35 | | or (b). |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2017. |
