11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 223.201, Transportation Code, is amended |
---|
13 | 13 | | by adding Subsection (f-1) and amending Subsections (g) and (j) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (f-1) This subsection expires August 31, 2021. |
---|
16 | 16 | | Notwithstanding Subsection (f), the department may enter into a |
---|
17 | 17 | | comprehensive development agreement for: |
---|
18 | 18 | | (1) the Interstate Highway 35 project in Travis and |
---|
19 | 19 | | Williamson Counties from Ranch-to-Market Road 1431 to State Highway |
---|
20 | 20 | | 45 Southeast; |
---|
21 | 21 | | (2) the Interstate Highway 45 North project in Harris |
---|
22 | 22 | | County from Beltway 8 to Interstate Highway 10; |
---|
23 | 23 | | (3) the Hempstead Managed Tollway project in Harris |
---|
24 | 24 | | County from State Highway 99 to the Interstate Highway |
---|
25 | 25 | | 610/Interstate Highway 10 interchange; |
---|
26 | 26 | | (4) the Interstate Highway 30 project in Tarrant |
---|
27 | 27 | | County from Interstate Highway 35W to east of Fielder Road; |

32 | 32 | | (g) The department may combine in a comprehensive |
---|
33 | 33 | | development agreement under this subchapter: |
---|
34 | 34 | | (1) a toll project and a rail facility as defined by |
---|
35 | 35 | | Section 91.001; or |
---|
36 | 36 | | (2) two or more projects described by this section |
---|
37 | 37 | | [Subsection (f)]. |
---|
38 | 38 | | (j) Before the department may enter into a comprehensive |
---|
39 | 39 | | development agreement under this section [Subsection (f)], the |
---|
40 | 40 | | department must: |
---|
41 | 41 | | (1) for a project other than the State Highway 99 |
---|
42 | 42 | | (Grand Parkway) project, obtain[, not later than August 31, 2017,] |
---|
43 | 43 | | the appropriate environmental clearance: |
---|
44 | 44 | | (A) for the project; or |
---|
45 | 45 | | (B) for the initial or base scope of the project |
---|
46 | 46 | | if the project agreement provides for the phased construction of |
---|
47 | 47 | | the project; and |
---|
48 | 48 | | (2) present to the commission a full financial plan |
---|
49 | 49 | | for the project, including costing methodology and cost proposals. |
---|
50 | 50 | | SECTION 2. Section 223.2011, Transportation Code, is |
---|
51 | 51 | | amended by adding Subsection (a-1) and amending Subsections (b) and |
---|
52 | 52 | | (f) to read as follows: |
---|
53 | 53 | | (a-1) This subsection expires August 31, 2021. |

54 | 54 | | Notwithstanding Sections 223.201(f) and 370.305(c), the department |

55 | 55 | | or a regional mobility authority may enter into a comprehensive |

60 | 60 | | (2) the Loop 1604 project in Bexar County; |
---|
61 | 61 | | (3) the Outer Parkway project in Cameron County from |
---|
62 | 62 | | U.S. Highway 77 to Farm-to-Market Road 1847; |
---|
63 | 63 | | (4) the South Padre Island Second Access Causeway |
---|
64 | 64 | | project in Cameron County from State Highway 100 to Park Road 100; |
---|
65 | 65 | | (5) the Farm-to-Market 1925 project from U.S. Highway |
---|
66 | 66 | | 281 in Hidalgo County to U.S. Highway 77 in Cameron County; |

82 | 82 | | (b) Before the department or an authority may enter into a |

83 | 83 | | comprehensive development agreement under this section, the |

84 | 84 | | department or the authority, as applicable, must: |

85 | 85 | | (1) obtain the appropriate environmental clearance: |
---|
86 | 86 | | (A) for the project; or |
---|
87 | 87 | | (B) for the initial or base scope of the project |
---|
88 | 88 | | if the project agreement provides for the phased construction of |
---|
89 | 89 | | the project; and |
---|
90 | 90 | | (2) present to the commission a full financial plan |
---|
91 | 91 | | for the project, including costing methodology and cost proposals |
---|
92 | 92 | | [meet the requirements under Section 223.201(j)]. |
---|
93 | 93 | | (f) The authority to enter into a comprehensive development |
---|
94 | 94 | | agreement under Subsection (a) [this section] expires August 31, |
---|
95 | 95 | | 2017. |
---|
96 | 96 | | SECTION 3. This Act takes effect immediately if it receives |
---|
97 | 97 | | a vote of two-thirds of all the members elected to each house, as |
---|
98 | 98 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
99 | 99 | | Act does not receive the vote necessary for immediate effect, this |
---|
100 | 100 | | Act takes effect September 1, 2017. |
