8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 6.037, Tax Code, is amended to read as |
---|
10 | 10 | | follows: |
---|
11 | 11 | | Sec. 6.037. PARTICIPATION OF CONSERVATION AND RECLAMATION |
---|
12 | 12 | | DISTRICTS IN APPRAISAL DISTRICT MATTERS. In this title, a |
---|
13 | 13 | | reference to the taxing units entitled to vote on the appointment of |
---|
14 | 14 | | appraisal district board members includes the conservation and |
---|
15 | 15 | | reclamation districts participating in the appraisal district, |
---|
16 | 16 | | without regard to whether the conservation and reclamation |
---|
17 | 17 | | districts are currently entitled to do so under Section 6.03(c). In |
---|
18 | 18 | | a provision of this title other than Section 6.03 or 6.031 that |
---|
19 | 19 | | grants authority to a majority or other number of the taxing units |
---|
20 | 20 | | entitled to vote on the appointment of appraisal district |
---|
21 | 21 | | directors, including [the disapproval of the appraisal district |
---|
22 | 22 | | budget under Section 6.06 and] the disapproval of appraisal |
---|
23 | 23 | | district board actions under Section 6.10, the conservation and |
---|
24 | 24 | | reclamation districts participating in the appraisal district are |
---|
25 | 25 | | given the vote or authority of one taxing unit. That vote or |
---|
26 | 26 | | authority is considered exercised only if a majority of the |
---|
27 | 27 | | conservation and reclamation districts take the same action to |
---|
28 | 28 | | exercise that vote or authority. Otherwise, the conservation and |
---|
29 | 29 | | reclamation districts are treated in the same manner as a single |
---|
30 | 30 | | taxing unit that is entitled to act but does not take any action on |
---|
31 | 31 | | the matter. |
---|
32 | 32 | | SECTION 2. Section 6.06(b), Tax Code, is amended to read as |
---|
33 | 33 | | follows: |
---|
34 | 34 | | (b) The board of directors shall hold a public hearing to |
---|
35 | 35 | | consider the budget. The secretary of the board shall deliver to |
---|
36 | 36 | | the presiding officer of the governing body of each taxing unit |
---|
37 | 37 | | participating in the district not later than the 10th day before the |
---|
38 | 38 | | date of the hearing a written notice of the date, time, and place |
---|
39 | 39 | | fixed for the hearing. The board shall complete its hearings, make |
---|
40 | 40 | | any amendments to the proposed budget it desires, and [finally] |
---|
41 | 41 | | approve a proposed budget before September 15. The board shall |
---|
42 | 42 | | submit the proposed budget to each taxing unit entitled to vote on |
---|
43 | 43 | | the appointment of board members for final approval. Not later than |
---|
44 | 44 | | the 30th day after the date the proposed budget is submitted to the |
---|
45 | 45 | | taxing units, the governing body of each taxing unit entitled to |
---|
46 | 46 | | vote on the appointment of board members shall vote to approve or |
---|
47 | 47 | | disapprove the proposed budget. The budget does not take effect |
---|
48 | 48 | | unless the [If] governing bodies of a majority of the taxing units |
---|
49 | 49 | | entitled to vote on the appointment of board members vote to approve |
---|
50 | 50 | | the budget by that date. If the budget is not approved by that date, |
---|
51 | 51 | | [adopt resolutions disapproving a budget and file them with the |
---|
52 | 52 | | secretary of the board within 30 days after its adoption, the budget |
---|
53 | 53 | | does not take effect, and] the board shall adopt a new proposed |
---|
54 | 54 | | budget and submit the proposed budget to each taxing unit entitled |
---|
55 | 55 | | to vote on the appointment of board members within 30 days [of the |
---|
56 | 56 | | disapproval]. |
---|
57 | 57 | | SECTION 3. Section 6.062(c), Tax Code, is amended to read as |
---|
58 | 58 | | follows: |
---|
59 | 59 | | (c) The notice must state that the appraisal district is |
---|
60 | 60 | | supported solely by payments from the local taxing units served by |
---|
61 | 61 | | the appraisal district. The notice must also contain the following |
---|
62 | 62 | | statement: "If approved by the appraisal district board of |
---|
63 | 63 | | directors at the public hearing and by the governing bodies of a |
---|
64 | 64 | | majority of the taxing units entitled to vote on the appointment of |
---|
65 | 65 | | members of the board of directors of the appraisal district, this |
---|
66 | 66 | | proposed budget will take effect [automatically unless disapproved |
---|
67 | 67 | | by the governing bodies of the county, school districts, cities, |
---|
68 | 68 | | and towns served by the appraisal district]. A copy of the proposed |
---|
69 | 69 | | budget is available for public inspection in the office of each of |
---|
70 | 70 | | those governing bodies." |
---|
71 | 71 | | SECTION 4. (a) This Act applies only to a proposed budget |
---|
72 | 72 | | of an appraisal district for which a public hearing is held under |
---|
73 | 73 | | Section 6.06(b), Tax Code, as amended by this Act, on or after the |
---|
74 | 74 | | effective date of this Act. |
---|
75 | 75 | | (b) A proposed budget for which a public hearing is held |
---|
76 | 76 | | before the effective date of this Act is governed by the law in |
---|
77 | 77 | | effect when the public hearing was held, and that law is continued |
---|
78 | 78 | | in effect for that purpose. |
---|
79 | 79 | | SECTION 5. This Act takes effect September 1, 2017. |
