77 relating to the adoption of the budget of an appraisal district.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 6.037, Tax Code, is amended to read as
1010 follows:
1111 Sec. 6.037. PARTICIPATION OF CONSERVATION AND RECLAMATION
1212 DISTRICTS IN APPRAISAL DISTRICT MATTERS. In this title, a
1313 reference to the taxing units entitled to vote on the appointment of
1414 appraisal district board members includes the conservation and
1515 reclamation districts participating in the appraisal district,
1616 without regard to whether the conservation and reclamation
1717 districts are currently entitled to do so under Section 6.03(c). In
1818 a provision of this title other than Section 6.03 or 6.031 that
1919 grants authority to a majority or other number of the taxing units
2020 entitled to vote on the appointment of appraisal district
2121 directors, including [the disapproval of the appraisal district
2222 budget under Section 6.06 and] the disapproval of appraisal
2323 district board actions under Section 6.10, the conservation and
2424 reclamation districts participating in the appraisal district are
2525 given the vote or authority of one taxing unit. That vote or
2626 authority is considered exercised only if a majority of the
2727 conservation and reclamation districts take the same action to
2828 exercise that vote or authority. Otherwise, the conservation and
2929 reclamation districts are treated in the same manner as a single
3030 taxing unit that is entitled to act but does not take any action on
3131 the matter.
3232 SECTION 2. Section 6.06(b), Tax Code, is amended to read as
3333 follows:
3434 (b) The board of directors shall hold a public hearing to
3535 consider the budget. The secretary of the board shall deliver to
3636 the presiding officer of the governing body of each taxing unit
3737 participating in the district not later than the 10th day before the
3838 date of the hearing a written notice of the date, time, and place
3939 fixed for the hearing. The board shall complete its hearings, make
4040 any amendments to the proposed budget it desires, and [finally]
4141 approve a proposed budget before September 15. The board shall
4242 submit the proposed budget to each taxing unit entitled to vote on
4343 the appointment of board members for final approval. Not later than
4444 the 30th day after the date the proposed budget is submitted to the
4545 taxing units, the governing body of each taxing unit entitled to
4646 vote on the appointment of board members shall vote to approve or
4747 disapprove the proposed budget. The budget does not take effect
4848 unless the [If] governing bodies of a majority of the taxing units
4949 entitled to vote on the appointment of board members vote to approve
5050 the budget by that date. If the budget is not approved by that date,
5151 [adopt resolutions disapproving a budget and file them with the
5252 secretary of the board within 30 days after its adoption, the budget
5353 does not take effect, and] the board shall adopt a new proposed
5454 budget and submit the proposed budget to each taxing unit entitled
5555 to vote on the appointment of board members within 30 days [of the
5656 disapproval].
5757 SECTION 3. Section 6.062(c), Tax Code, is amended to read as
5858 follows:
5959 (c) The notice must state that the appraisal district is
6060 supported solely by payments from the local taxing units served by
6161 the appraisal district. The notice must also contain the following
6262 statement: "If approved by the appraisal district board of
6363 directors at the public hearing and by the governing bodies of a
6464 majority of the taxing units entitled to vote on the appointment of
6565 members of the board of directors of the appraisal district, this
6666 proposed budget will take effect [automatically unless disapproved
6767 by the governing bodies of the county, school districts, cities,
6868 and towns served by the appraisal district]. A copy of the proposed
6969 budget is available for public inspection in the office of each of
7070 those governing bodies."
7171 SECTION 4. (a) This Act applies only to a proposed budget
7272 of an appraisal district for which a public hearing is held under
7373 Section 6.06(b), Tax Code, as amended by this Act, on or after the
7474 effective date of this Act.
7575 (b) A proposed budget for which a public hearing is held
7676 before the effective date of this Act is governed by the law in
7777 effect when the public hearing was held, and that law is continued
7878 in effect for that purpose.
7979 SECTION 5. This Act takes effect September 1, 2017.
