| 7 | 7 | | relating to providing information regarding immunization |

| 8 | 8 | | requirements for admission to public elementary and secondary |
|---|
| 9 | 9 | | schools. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 38.019, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsections (a) and (a-1) and adding Subsections (c) and |
|---|
| 13 | 13 | | (d) to read as follows: |
|---|
| 14 | 14 | | (a) A school district that maintains an Internet website |
|---|
| 15 | 15 | | shall post prominently on the website: |
|---|
| 16 | 16 | | (1) a list, in English and Spanish, of: |
|---|
| 17 | 17 | | (A) the immunizations required for admission to |
|---|
| 18 | 18 | | public school by rules of the Department of State Health Services |
|---|
| 19 | 19 | | adopted under Section 38.001; |
|---|
| 20 | 20 | | (B) any immunizations or vaccines recommended |
|---|
| 21 | 21 | | for public school students by the Department of State Health |
|---|
| 22 | 22 | | Services; and |
|---|
| 23 | 23 | | (C) health clinics in the district that offer the |
|---|
| 24 | 24 | | influenza vaccine, to the extent those clinics are known to the |
|---|
| 25 | 25 | | district; and |
|---|
| 26 | 26 | | (2) a direct link to the Department of State Health |
|---|
| 27 | 27 | | Services Internet website where a person may obtain information on |
|---|
| 28 | 28 | | exemptions from immunizations required for admission to an |
|---|
| 29 | 29 | | elementary or secondary school as provided by Section 38.001, |
|---|
| 30 | 30 | | including [relating to] the procedures for claiming an exemption |
|---|
| 31 | 31 | | from the immunization requirements [of Section 38.001]. |
|---|
| 32 | 32 | | (a-1) The link to the Department of State Health Services |
|---|
| 33 | 33 | | Internet website provided under Subsection (a)(2) must be presented |
|---|
| 34 | 34 | | in the same manner, including the same font style and size, as the |
|---|
| 35 | 35 | | information provided under Subsection (a)(1). |
|---|
| 36 | 36 | | (c) If a school district provides written notice or other |
|---|
| 37 | 37 | | written information relating to immunizations required for |
|---|
| 38 | 38 | | admission to an elementary or secondary school as provided by |
|---|
| 39 | 39 | | Section 38.001, the district shall include: |
|---|
| 40 | 40 | | (1) specific information on exemptions from the |
|---|
| 41 | 41 | | required immunizations; and |
|---|
| 42 | 42 | | (2) the direct link to the Department of State Health |
|---|
| 43 | 43 | | Services Internet website described by Subsection (a)(2). |
|---|
| 44 | 44 | | (d) The information provided under Subsections (c)(1) and |
|---|
| 45 | 45 | | (2) must be presented in the same manner, including the same font |
|---|
| 46 | 46 | | style and size, as the other information provided on immunizations. |
|---|
| 47 | 47 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 48 | 48 | | school year. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2017. |
