55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing information regarding immunization
88 requirements for admission to public elementary and secondary
99 schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 38.019, Education Code, is amended by
1212 amending Subsections (a) and (a-1) and adding Subsections (c) and
1313 (d) to read as follows:
1414 (a) A school district that maintains an Internet website
1515 shall post prominently on the website:
1616 (1) a list, in English and Spanish, of:
1717 (A) the immunizations required for admission to
1818 public school by rules of the Department of State Health Services
1919 adopted under Section 38.001;
2020 (B) any immunizations or vaccines recommended
2121 for public school students by the Department of State Health
2222 Services; and
2323 (C) health clinics in the district that offer the
2424 influenza vaccine, to the extent those clinics are known to the
2525 district; and
2626 (2) a direct link to the Department of State Health
2727 Services Internet website where a person may obtain information on
2828 exemptions from immunizations required for admission to an
2929 elementary or secondary school as provided by Section 38.001,
3030 including [relating to] the procedures for claiming an exemption
3131 from the immunization requirements [of Section 38.001].
3232 (a-1) The link to the Department of State Health Services
3333 Internet website provided under Subsection (a)(2) must be presented
3434 in the same manner, including the same font style and size, as the
3535 information provided under Subsection (a)(1).
3636 (c) If a school district provides written notice or other
3737 written information relating to immunizations required for
3838 admission to an elementary or secondary school as provided by
3939 Section 38.001, the district shall include:
4040 (1) specific information on exemptions from the
4141 required immunizations; and
4242 (2) the direct link to the Department of State Health
4343 Services Internet website described by Subsection (a)(2).
4444 (d) The information provided under Subsections (c)(1) and
4545 (2) must be presented in the same manner, including the same font
4646 style and size, as the other information provided on immunizations.
4747 SECTION 2. This Act applies beginning with the 2017-2018
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
