| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 28.002, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (l-4) to read as follows: |
|---|
| 13 | 13 | | (l-4) The agency shall develop and institute policies on the |
|---|
| 14 | 14 | | recess period during the school day that encourage constructive, |
|---|
| 15 | 15 | | age-appropriate outdoor playtime. The policies must include |
|---|
| 16 | 16 | | guidelines for outdoor equipment and facilities on public school |
|---|
| 17 | 17 | | campuses that maximize the effectiveness of outdoor physical |
|---|
| 18 | 18 | | activity. |

| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2017. |
