66 AN ACT
77 relating to a personal bond office and pretrial services in certain
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article 17.42, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 Sec. 1. (a) Except as provided by Subsection (b), any [Any]
1313 county, or any judicial district with jurisdiction in more than one
1414 county, with the approval of the commissioners court of each county
1515 in the district, may establish a personal bond office to gather and
1616 review information about an accused that may have a bearing on
1717 whether the accused [he] will comply with the conditions of a
1818 personal bond and report its findings to the court before which the
1919 case is pending.
2020 (b) The commissioners court of a county with a population of
2121 700,000 or more but less than 780,000 shall establish a personal
2222 bond office for that county. In addition to the duties described by
2323 Subsection (a), an office established under this subsection must
2424 implement a pretrial services program to provide services related
2525 to defendants released on bail in the county, including supervising
2626 and otherwise monitoring a defendant to ensure the defendant's:
2727 (1) compliance with conditions of bail; and
2828 (2) appearance in court as required.
2929 SECTION 2. Not later than January 1, 2018, the
3030 commissioners court of a county described by Section 1(b), Article
3131 17.42, Code of Criminal Procedure, as added by this Act, shall
3232 establish the personal bond office as required by that section.
3333 SECTION 3. This Act takes effect September 1, 2017.
