66 AN ACT
77 relating to the regulation of discrimination by political
88 subdivisions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 250, Local Government
1111 Code, is amended to read as follows:
1212 CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY OF
1313 MUNICIPALITIES, [AND] COUNTIES, AND OTHER LOCAL GOVERNMENTS
1414 SECTION 2. Chapter 250, Local Government Code, is amended
1515 by adding Section 250.008 to read as follows:
1616 Sec. 250.008. CERTAIN REGULATION OF DISCRIMINATION
1717 PROHIBITED. (a) A political subdivision may not adopt an order,
1818 ordinance, or other measure to:
1919 (1) protect a class of persons from discrimination; or
2020 (2) reduce or expand a class of persons protected
2121 under state law from discrimination.
2222 (b) An order, ordinance, or other measure that is adopted by
2323 a political subdivision before the date this section becomes law
2424 and that violates Subsection (a) is null and void.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2017.
