| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Chapter 250, Local Government |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY OF |
|---|
| 13 | 13 | | MUNICIPALITIES, [AND] COUNTIES, AND OTHER LOCAL GOVERNMENTS |
|---|
| 14 | 14 | | SECTION 2. Chapter 250, Local Government Code, is amended |
|---|
| 15 | 15 | | by adding Section 250.008 to read as follows: |
|---|
| 16 | 16 | | Sec. 250.008. CERTAIN REGULATION OF DISCRIMINATION |
|---|
| 17 | 17 | | PROHIBITED. (a) A political subdivision may not adopt an order, |
|---|
| 18 | 18 | | ordinance, or other measure to: |
|---|
| 19 | 19 | | (1) protect a class of persons from discrimination; or |
|---|
| 20 | 20 | | (2) reduce or expand a class of persons protected |
|---|
| 21 | 21 | | under state law from discrimination. |
|---|
| 22 | 22 | | (b) An order, ordinance, or other measure that is adopted by |
|---|
| 23 | 23 | | a political subdivision before the date this section becomes law |
|---|
| 24 | 24 | | and that violates Subsection (a) is null and void. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
