66 AN ACT
77 relating to authorization by the Texas Higher Education
88 Coordinating Board for certain public junior colleges to offer
99 baccalaureate degree programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 130.0012, Education Code, is amended by
1212 amending Subsections (a), (d), (e), and (g), and adding Subsections
1313 (b-4), (e-1), and (g-1) to read as follows:
1414 (a) The Texas Higher Education Coordinating Board shall
1515 authorize public junior colleges to offer baccalaureate degree
1616 programs in the fields of applied science, [and] applied
1717 technology, and nursing under this section. Offering a
1818 baccalaureate degree program under this section does not otherwise
1919 alter the role and mission of a public junior college.
2020 (b-4) The coordinating board shall authorize baccalaureate
2121 degree programs at one or more public junior colleges that offer a
2222 degree program in the field of nursing and have demonstrated a
2323 workforce need.
2424 (d) A public junior college offering a baccalaureate degree
2525 program under this section may not offer more than six [five]
2626 baccalaureate degree programs at any time. The degree programs are
2727 subject to the continuing approval of the coordinating board.
2828 (e) In determining whether a public junior college may offer
2929 [what] baccalaureate degree programs and what degree programs may
3030 [are to] be offered, the coordinating board shall:
3131 (1) apply the same criteria and standards the
3232 coordinating board uses to approve baccalaureate degree programs at
3333 general academic teaching institutions; and
3434 (2) consider the following factors:
3535 (A) [(1)] the workforce need for the degree
3636 programs in the region served by the junior college;
3737 (B) [(2)] how those degree programs would
3838 complement the other programs and course offerings of the junior
3939 college and whether the associate degree program offered by the
4040 junior college in the same field has been successful;
4141 (C) [(3)] whether those degree programs would
4242 unnecessarily duplicate the degree programs offered by other
4343 institutions of higher education; and
4444 (D) [(4)] the ability of the junior college to
4545 support the degree programs with student enrollment [program] and
4646 the adequacy of the junior college's facilities, faculty,
4747 administration, libraries, and other resources.
4848 (e-1) A public junior college may offer a baccalaureate
4949 degree program under this section only if its junior college
5050 district meets the taxable property valuation amount established in
5151 Section 130.032.
5252 (g) Except as provided by Subsection (g-1), in [In] its
5353 recommendations to the legislature relating to state funding for
5454 public junior colleges, the coordinating board shall recommend that
5555 a public junior college receive substantially the same state
5656 support for junior-level and senior-level courses offered under
5757 this section as that provided to a general academic teaching
5858 institution for substantially similar courses. In determining the
5959 contact hours attributable to students enrolled in a junior-level
6060 or senior-level course offered under this section used to determine
6161 a public junior college's proportionate share of state
6262 appropriations under Section 130.003, the coordinating board shall
6363 weigh those contact hours as necessary to provide the junior
6464 college the appropriate level of state support to the extent state
6565 funds for those courses are included in the appropriations. This
6666 subsection does not prohibit the legislature from directly
6767 appropriating state funds to support junior-level and senior-level
6868 courses offered under this section.
6969 (g-1) For the first two years in which a degree program
7070 created under Subsection (b-4) is offered, the degree program may
7171 be funded solely by a public junior college's proportionate share
7272 of state appropriations under Section 130.003, local funds, and
7373 private sources. This subsection does not require the legislature
7474 to appropriate state funds to support a degree program created
7575 under Subsection (b-4).
7676 SECTION 2. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2017.
