55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reimbursement rates for certain therapy services under
88 Medicaid and accountability to Medicaid recipients.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 531.021, Government Code, is amended by
1111 adding Subsection (h) to read as follows:
1212 (h) In adopting rates for Medicaid payments under
1313 Subsection (b-1), the executive commissioner shall ensure that
1414 reimbursement rates for occupational, physical, and speech therapy
1515 services provided to recipients are at least equal to the
1616 reimbursement rates for occupational, physical, and speech therapy
1717 services in effect on August 31, 2015, regardless of whether the
1818 reimbursements are paid through a fee for service system or a
1919 managed care system. The executive commissioner shall adopt rules
2020 to ensure the accountability of the commission to recipients who
2121 are dependent on those therapy services.
2222 SECTION 2. As soon as practicable after the effective date
2323 of this Act, the executive commissioner of the Health and Human
2424 Services Commission shall adopt the rules required by Section
2525 531.021(h), Government Code, as added by this Act.
2626 SECTION 3. If before implementing any provision of this Act
2727 a state agency determines that a waiver or authorization from a
2828 federal agency is necessary for implementation of that provision,
2929 the agency affected by the provision shall request the waiver or
3030 authorization and may delay implementing that provision until the
3131 waiver or authorization is granted.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2017.
