66 AN ACT
77 relating to requiring a public institution of higher education to
88 post on its Internet website a status report regarding certain
99 disciplinary processes involving an incident of campus sexual
1010 assault.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.9367 to read as follows:
1414 Sec. 51.9367. STATUS REPORT OF DISCIPLINARY PROCESSES
1515 INVOLVING CAMPUS SEXUAL ASSAULT. (a) In this section,
1616 "institution of higher education" has the meaning assigned by
1717 Section 61.003.
1818 (b) Each institution of higher education shall post on the
1919 institution's Internet website in a manner accessible by the public
2020 a status report regarding each of the institution's pending or
2121 recently concluded disciplinary processes involving an incident of
2222 campus sexual assault.
2323 (c) For each disciplinary process required to be included in
2424 the status report under this section, the status report:
2525 (1) must include:
2626 (A) the date on which the sexual assault was
2727 reported to the institution;
2828 (B) the employee or employees of the institution
2929 responsible for resolving the disciplinary process;
3030 (C) the stage of the disciplinary process; and
3131 (D) when applicable, the outcome of the
3232 disciplinary process; and
3333 (2) may not identify any alleged perpetrator or
3434 alleged victim of the sexual assault.
3535 (d) The status report must be updated at least once per
3636 month.
3737 (e) Information regarding a disciplinary process required
3838 to be included in the status report under Subsection (c):
3939 (1) may not be removed from the institution's Internet
4040 website until at least the 90th day after the date on which the
4141 disciplinary process concludes; and
4242 (2) must be preserved by the institution indefinitely
4343 after removal from the institution's Internet website.
4444 SECTION 2. Section 51.9367, Education Code, as added by
4545 this Act, applies only to a disciplinary process initiated by a
4646 public institution of higher education on or after the effective
4747 date of this Act. A disciplinary process initiated before the
4848 effective date of this Act is governed by the law in effect on the
4949 date the disciplinary process was initiated, and the former law is
5050 continued in effect for that purpose.
5151 SECTION 3. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2017.
