7 | 7 | relating to the distribution, sale, or offer for sale of a | |
8 | 8 | mislabeled abusable synthetic substance through the Internet. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 484.001(2), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (2) "Business" includes trade and commerce and | |
13 | 13 | advertising, selling, and buying service or property and the use of | |
14 | 14 | the Internet to perform these activities. | |
15 | 15 | SECTION 2. (a) The change in law made by this Act to Section | |
16 | 16 | 484.001(2), Health and Safety Code, applies only to conduct | |
17 | 17 | constituting an offense or forming the basis for a civil cause of | |
18 | 18 | action that accrues on or after the effective date of this Act. | |
19 | 19 | (b) For purposes of this section, an offense was committed | |
20 | 20 | before the effective date of this Act if any element of the offense | |
21 | 21 | occurred before that date. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2017. |
