55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to evaluating the performance of public school districts
88 and campuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.053(c), Education Code, is amended to
1111 read as follows:
1212 (c) School districts and campuses must be evaluated based on
1313 five domains of indicators of achievement adopted under this
1414 section that include:
1515 (1) in the first domain, the results of:
1616 (A) assessment instruments required under
1717 Sections 39.023(a), (c), and (l), including the results of
1818 assessment instruments required for graduation retaken by a
1919 student, aggregated across grade levels by subject area, including:
2020 (i) for the performance standard determined
2121 by the commissioner under Section 39.0241(a), the percentage of
2222 students who performed satisfactorily on the assessment
2323 instruments, aggregated across grade levels by subject area; and
2424 (ii) for the college readiness performance
2525 standard as determined under Section 39.0241, the percentage of
2626 students who performed satisfactorily on the assessment
2727 instruments, aggregated across grade levels by subject area; and
2828 (B) assessment instruments required under
2929 Section 39.023(b), aggregated across grade levels by subject area,
3030 including the percentage of students who performed satisfactorily
3131 on the assessment instruments, as determined by the performance
3232 standard adopted by the agency, aggregated across grade levels by
3333 subject area;
3434 (2) in the second domain:
3535 (A) for assessment instruments under Subdivision
3636 (1)(A):
3737 (i) for the performance standard determined
3838 by the commissioner under Section 39.0241(a), the percentage of
3939 students who met the standard for annual improvement on the
4040 assessment instruments, as determined by the commissioner by rule
4141 or by the method for measuring annual improvement under Section
4242 39.034, aggregated across grade levels by subject area; and
4343 (ii) for the college readiness performance
4444 standard as determined under Section 39.0241, the percentage of
4545 students who met the standard for annual improvement on the
4646 assessment instruments, as determined by the commissioner by rule
4747 or by the method for measuring annual improvement under Section
4848 39.034, aggregated across grade levels by subject area; and
4949 (B) for assessment instruments under Subdivision
5050 (1)(B), the percentage of students who met the standard for annual
5151 improvement on the assessment instruments, as determined by the
5252 commissioner by rule or by the method for measuring annual
5353 improvement under Section 39.034, aggregated across grade levels by
5454 subject area;
5555 (3) in the third domain, the student academic
5656 achievement differentials among students from different racial and
5757 ethnic groups and socioeconomic backgrounds;
5858 (4) in the fourth domain:
5959 (A) for evaluating the performance of high school
6060 campuses and districts that include high school campuses:
6161 (i) dropout rates, including dropout rates
6262 and district completion rates for grade levels 9 through 12,
6363 computed in accordance with standards and definitions adopted by
6464 the National Center for Education Statistics of the United States
6565 Department of Education;
6666 (ii) high school graduation rates, computed
6767 in accordance with standards and definitions adopted in compliance
6868 with the Every Student Succeeds Act [No Child Left Behind Act of
6969 2001] (20 U.S.C. Section 6301 et seq.);
7070 (iii) the percentage of students who
7171 successfully completed the curriculum requirements for the
7272 distinguished level of achievement under the foundation high school
7373 program;
7474 (iv) the percentage of students who
7575 successfully completed the curriculum requirements for an
7676 endorsement under Section 28.025(c-1);
7777 (v) the percentage of students who
7878 completed a coherent sequence of career and technical courses;
7979 (vi) the percentage of students who satisfy
8080 the Texas Success Initiative (TSI) college readiness benchmarks
8181 prescribed by the Texas Higher Education Coordinating Board under
8282 Section 51.3062(f) on an assessment instrument in reading, writing,
8383 or mathematics designated by the Texas Higher Education
8484 Coordinating Board under Section 51.3062(c);
8585 (vii) the percentage of students who earn
8686 at least 12 hours of postsecondary credit required for the
8787 foundation high school program under Section 28.025 or to earn an
8888 endorsement under Section 28.025(c-1);
8989 (viii) the percentage of students who have
9090 completed an advanced placement course;
9191 (ix) the percentage of students who enlist
9292 in the armed forces of the United States; and
9393 (x) the percentage of students who earn an
9494 industry certification;
9595 (B) for evaluating the performance of middle and
9696 junior high school [and elementary school] campuses and districts
9797 that include those campuses:
9898 (i) student attendance; [and]
9999 (ii) [for middle and junior high school
100100 campuses:
101101 [(a)] dropout rates, computed in the
102102 manner described by Paragraph (A)(i); and
103103 (iii) [(b)] the percentage of students in
104104 grades seven and eight who receive instruction in preparing for
105105 high school, college, and a career that includes information
106106 regarding the creation of a high school personal graduation plan
107107 under Section 28.02121, the distinguished level of achievement
108108 described by Section 28.025(b-15), each endorsement described by
109109 Section 28.025(c-1), college readiness standards, and potential
110110 career choices and the education needed to enter those careers; and
111111 (C) any additional indicators of student
112112 achievement not associated with performance on standardized
113113 assessment instruments determined appropriate for consideration by
114114 the commissioner in consultation with educators, parents, business
115115 and industry representatives, and employers; and
116116 (5) in the fifth domain, three programs or specific
117117 categories of performance related to community and student
118118 engagement locally selected and evaluated as provided by Section
119119 39.0546.
120120 SECTION 2. Section 39.054(a-1), Education Code, is amended
121121 to read as follows:
122122 (a-1) For purposes of assigning an overall performance
123123 rating under Subsection (a), the commissioner shall attribute:
124124 (1) 55 percent of the performance evaluation to the
125125 achievement indicators for the first, second, and third domains
126126 under Sections 39.053(c)(1)-(3);
127127 (2) for elementary school campuses and districts that
128128 include only those campuses, an additional 35 percent of the
129129 performance evaluation to the achievement indicators for the first,
130130 second, and third domains under Sections 39.053(c)(1)-(3);
131131 (3) for middle and junior high school [and elementary]
132132 campuses and districts that include only middle and junior high
133133 school and elementary school [those] campuses, 35 percent of the
134134 performance evaluation to the applicable achievement indicators
135135 for the fourth domain under Section 39.053(c)(4);
136136 (4) [(3)] for high school campuses and districts that
137137 include those campuses:
138138 (A) 10 percent of the performance evaluation to
139139 the high school graduation rate achievement indicator described by
140140 Section 39.053(c)(4)(A)(ii); and
141141 (B) 25 percent to the remaining applicable
142142 achievement indicators for the fourth domain under Section
143143 39.053(c)(4); and
144144 (5) [(4)] 10 percent of the performance evaluation to
145145 the locally selected and evaluated achievement indicators provided
146146 for under the fifth domain under Section 39.053(c)(5).
147147 SECTION 3. This Act applies beginning with the 2017-2018
148148 school year.
149149 SECTION 4. This Act takes effect immediately if it receives
150150 a vote of two-thirds of all the members elected to each house, as
151151 provided by Section 39, Article III, Texas Constitution. If this
152152 Act does not receive the vote necessary for immediate effect, this
153153 Act takes effect September 1, 2017.
