| 10 | 10 | | solid waste facilities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. In this Act: |
|---|
| 13 | 13 | | (1) "Commission" means the Texas Commission on |
|---|
| 14 | 14 | | Environmental Quality. |
|---|
| 15 | 15 | | (2) "Solid waste facility" has the meaning assigned by |
|---|
| 16 | 16 | | Section 361.003, Health and Safety Code. |
|---|
| 17 | 17 | | SECTION 2. (a) The commission shall conduct an assessment |
|---|
| 18 | 18 | | of the safety and regulation of municipal solid waste facilities in |
|---|
| 19 | 19 | | this state. The assessment must consider: |
|---|
| 20 | 20 | | (1) the permit application and approval process; |
|---|
| 21 | 21 | | (2) restrictions regarding the location of municipal |
|---|
| 22 | 22 | | solid waste facilities; |
|---|
| 23 | 23 | | (3) inspections and enforcement of regulations |
|---|
| 24 | 24 | | regarding municipal solid waste facilities; and |
|---|
| 25 | 25 | | (4) any other matters the commission considers |
|---|
| 26 | 26 | | appropriate. |
|---|
| 27 | 27 | | (b) Not later than September 1, 2018, the commission shall |
|---|
| 28 | 28 | | provide to each standing committee of the legislature with primary |
|---|
| 29 | 29 | | jurisdiction over environmental regulation a detailed written |
|---|
| 30 | 30 | | report regarding the assessment conducted under this section. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2017. |
