44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to off-site sales by a dealer for antique or special
77 interest vehicles that have been subject to a retail sale.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1.
1010 Section 503.024(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) For the purposes of Section 503.021, a domiciliary of
1313 another state who holds a dealer license and bond, if applicable,
1414 issued by the other state is not engaging in business as a dealer
1515 by:
1616 (1) buying a vehicle from, selling a vehicle to, or
1717 exchanging a vehicle with a person who:
1818 (A) [(1)] holds a general distinguishing number
1919 issued by the department, if the transaction is not intended to
2020 avoid a requirement of this chapter; or
2121 (B) [(2)] is a domiciliary of another state who
2222 holds a dealer license and bond, if applicable, issued by the other
2323 state and the transaction is not intended to avoid a requirement of
2424 this chapter; or
2525 (2) buying, selling, including by consignment, or
2626 exchanging at a public auction:
2727 (A) an antique vehicle that is at least 25 years
2828 of age; or
2929 (B) a special interest vehicle that:
3030 (i) is at least 12 years of age; or
3131 (ii) has been the subject of a retail sale.
3232 SECTION 2. This Act takes effect September 1, 2017.
