| 7 | 7 | | interest vehicles that have been subject to a retail sale. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. |
|---|
| 10 | 10 | | Section 503.024(c), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) For the purposes of Section 503.021, a domiciliary of |
|---|
| 13 | 13 | | another state who holds a dealer license and bond, if applicable, |
|---|
| 14 | 14 | | issued by the other state is not engaging in business as a dealer |
|---|
| 15 | 15 | | by: |
|---|
| 16 | 16 | | (1) buying a vehicle from, selling a vehicle to, or |
|---|
| 17 | 17 | | exchanging a vehicle with a person who: |
|---|
| 18 | 18 | | (A) [(1)] holds a general distinguishing number |
|---|
| 19 | 19 | | issued by the department, if the transaction is not intended to |
|---|
| 20 | 20 | | avoid a requirement of this chapter; or |
|---|
| 21 | 21 | | (B) [(2)] is a domiciliary of another state who |
|---|
| 22 | 22 | | holds a dealer license and bond, if applicable, issued by the other |
|---|
| 23 | 23 | | state and the transaction is not intended to avoid a requirement of |
|---|
| 24 | 24 | | this chapter; or |
|---|
| 25 | 25 | | (2) buying, selling, including by consignment, or |
|---|
| 26 | 26 | | exchanging at a public auction: |
|---|
| 27 | 27 | | (A) an antique vehicle that is at least 25 years |
|---|
| 28 | 28 | | of age; or |
|---|
| 29 | 29 | | (B) a special interest vehicle that: |
|---|
| 30 | 30 | | (i) is at least 12 years of age; or |
|---|
| 31 | 31 | | (ii) has been the subject of a retail sale. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2017. |
