| 6 | 6 | | relating to creating an offense for the administration of illegal |

| 7 | 7 | | drugs to breeder deer. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 43.365(a), Parks and Wildlife Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) It is an offense if a deer breeder or another person: |
|---|
| 12 | 12 | | (1) allows the hunting or killing of a breeder deer or |
|---|
| 13 | 13 | | any other deer held in captivity in a facility permitted under this |
|---|
| 14 | 14 | | subchapter, except as provided by this subchapter or a rule adopted |
|---|
| 15 | 15 | | by the commission under this subchapter; [or] |
|---|
| 16 | 16 | | (2) knowingly sells, arranges the sale of, purchases, |
|---|
| 17 | 17 | | transfers, receives, or attempts to sell, arrange the sale of, |
|---|
| 18 | 18 | | purchase, transfer, or receive a live breeder deer in violation of |
|---|
| 19 | 19 | | this subchapter or a rule adopted by the commission under this |
|---|
| 20 | 20 | | subchapter; or |
|---|
| 21 | 21 | | (3) administers or utilizes an illegal drug or drug |
|---|
| 22 | 22 | | product in deer for the sole purpose of improving body appearance or |
|---|
| 23 | 23 | | enhancing antler growth. This subdivision does not apply to the use |
|---|
| 24 | 24 | | of approved pharmaceuticals recommended by a veterinarian for |
|---|
| 25 | 25 | | medicinal purposes in deer. |
|---|
| 26 | 26 | | SECTION 2. Section 43.367(b), Parks and Wildlife Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (b) A person who violates Section 43.365(a)(1) or (3) |
|---|
| 29 | 29 | | commits an offense that is a Class A Parks and Wildlife Code |
|---|
| 30 | 30 | | misdemeanor. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2017. |
