55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing or administering low-THC cannabis to a child
88 for whom the low-THC cannabis was prescribed.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 487.001, Health and Safety Code, is
1111 amended by adding Subdivision (5) to read as follows:
1212 (5) "Child" means a person under 18 years of age.
1313 SECTION 2. Subchapter B, Chapter 487, Health and Safety
1414 Code, is amended by adding Section 487.055 to read as follows:
1515 Sec. 487.055. PROVISION OR ADMINISTRATION TO CHILD. It is
1616 not child abuse or neglect, as those terms are defined under Section
1717 261.001, Family Code, for a parent or other caregiver to provide or
1818 administer low-THC cannabis to a child for whom the low-THC
1919 cannabis was prescribed under Chapter 169, Occupations Code.
2020 SECTION 3. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2017.
