9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 487.001, Health and Safety Code, is | |
11 | 11 | amended by adding Subdivision (5) to read as follows: | |
12 | 12 | (5) "Child" means a person under 18 years of age. | |
13 | 13 | SECTION 2. Subchapter B, Chapter 487, Health and Safety | |
14 | 14 | Code, is amended by adding Section 487.055 to read as follows: | |
15 | 15 | Sec. 487.055. PROVISION OR ADMINISTRATION TO CHILD. It is | |
16 | 16 | not child abuse or neglect, as those terms are defined under Section | |
17 | 17 | 261.001, Family Code, for a parent or other caregiver to provide or | |
18 | 18 | administer low-THC cannabis to a child for whom the low-THC | |
19 | 19 | cannabis was prescribed under Chapter 169, Occupations Code. | |
20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2017. |
