66 AN ACT
77 relating to the time for holding certain runoff elections.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 2.025(c) and (d), Election Code, are
1010 amended to read as follows:
1111 (c) This section supersedes a law outside this code
1212 [subchapter] to the extent of any [a] conflict notwithstanding
1313 Section 2.022.
1414 (d) Except as otherwise provided by this code, a [A] runoff
1515 election for a special election to fill a vacancy in Congress or a
1616 special election to fill a vacancy in the legislature [to which
1717 Section 101.104 applies] shall be held not earlier than the 70th day
1818 or later than the 84th [77th] day after the date the final canvass
1919 of the main election is completed.
2020 SECTION 2. Section 203.004(b), Election Code, is amended to
2121 read as follows:
2222 (b) If the election is to be held as an emergency election,
2323 it shall be held on a Tuesday or Saturday occurring on or after the
2424 36th day and before the 50th day after the date the election is
2525 ordered. Any necessary runoff election must be held on a Tuesday or
2626 Saturday occurring not earlier than the 20th day or later than the
2727 45th day after the date the final canvass of the main election is
2828 completed.
2929 SECTION 3. The change in law made by this Act applies only
3030 to an election ordered on or after the effective date of this Act.
3131 An election ordered before the effective date of this Act is
3232 governed by the law in effect when the election was ordered, and the
3333 former law is continued in effect for that purpose.
3434 SECTION 4. This Act takes effect September 1, 2017.
