| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 2.025(c) and (d), Election Code, are |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (c) This section supersedes a law outside this code |
|---|
| 12 | 12 | | [subchapter] to the extent of any [a] conflict notwithstanding |
|---|
| 13 | 13 | | Section 2.022. |
|---|
| 14 | 14 | | (d) Except as otherwise provided by this code, a [A] runoff |
|---|
| 15 | 15 | | election for a special election to fill a vacancy in Congress or a |
|---|
| 16 | 16 | | special election to fill a vacancy in the legislature [to which |
|---|
| 17 | 17 | | Section 101.104 applies] shall be held not earlier than the 70th day |

| 18 | 18 | | or later than the 84th [77th] day after the date the final canvass |
|---|
| 19 | 19 | | of the main election is completed. |

| 20 | 20 | | SECTION 2. Section 203.004(b), Election Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (b) If the election is to be held as an emergency election, |
|---|
| 23 | 23 | | it shall be held on a Tuesday or Saturday occurring on or after the |
|---|
| 24 | 24 | | 36th day and before the 50th day after the date the election is |
|---|
| 25 | 25 | | ordered. Any necessary runoff election must be held on a Tuesday or |
|---|
| 26 | 26 | | Saturday occurring not earlier than the 20th day or later than the |
|---|
| 27 | 27 | | 45th day after the date the final canvass of the main election is |
|---|
| 28 | 28 | | completed. |
|---|
| 29 | 29 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an election ordered on or after the effective date of this Act. |
|---|
| 31 | 31 | | An election ordered before the effective date of this Act is |
|---|
| 32 | 32 | | governed by the law in effect when the election was ordered, and the |
|---|
| 33 | 33 | | former law is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect September 1, 2017. |
