55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to voting a limited ballot.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 112.002(a) and (d), Election Code, are
1010 amended to read as follows:
1111 (a) After changing residence to another county, a person is
1212 eligible to vote a limited ballot on election day, by personal
1313 appearance during the early voting period, or by mail if:
1414 (1) the person would have been eligible to vote in the
1515 county of former residence on election day if still residing in that
1616 county;
1717 (2) the person is registered to vote in the county of
1818 former residence at the time the person:
1919 (A) offers to vote in the county of new
2020 residence; or
2121 (B) submitted a voter registration application
2222 in the county of new residence; and
2323 (3) a voter registration for the person in the county
2424 of new residence is not effective on or before election day.
2525 (d) A statement executed under Subsection (c) shall be
2626 submitted:
2727 (1) to an election officer at the [main early voting]
2828 polling place[, if the person is voting by personal appearance]; or
2929 (2) with the person's application for a ballot to be
3030 voted by mail, if the person is voting by mail.
3131 SECTION 2. Section 112.004, Election Code, is amended to
3232 read as follows:
3333 Sec. 112.004. OFFICES AND MEASURES ON WHICH VOTER ENTITLED
3434 TO VOTE. A person voting a limited ballot is entitled to vote only
3535 on[:
3636 [(1)] each office and proposition stating a measure to
3737 be voted on statewide[; and
3838 [(2) each office and proposition stating a measure to
3939 be voted on in a territorial unit of which the person was a resident
4040 both before changing county of residence and after the change].
4141 SECTION 3. Section 112.006, Election Code, is amended to
4242 read as follows:
4343 Sec. 112.006. PLACE FOR VOTING BY PERSONAL APPEARANCE. A
4444 person may vote a limited ballot by personal appearance:
4545 (1) at any early voting polling place; or
4646 (2) at the discretion of the county clerk, on election
4747 day at:
4848 (A) a countywide polling place or the polling
4949 place located in the precinct of the new residence of the voter; or
5050 (B) the clerk's office or the location that
5151 served as [only at] the main early voting polling place.
5252 SECTION 4. Section 112.009, Election Code, is amended to
5353 read as follows:
5454 Sec. 112.009. PREPARING VOTING MACHINE. Before permitting
5555 a person to vote a limited ballot on a voting machine, the county
5656 [early voting] clerk shall adjust the machine so that votes may be
5757 cast only on each office and proposition stating a measure to be
5858 voted on statewide [the offices and propositions stating measures
5959 on which the voter is entitled to vote].
6060 SECTION 5. Section 112.010(a), Election Code, is amended to
6161 read as follows:
6262 (a) If [early] voting [by personal appearance] is conducted
6363 by voting machine, the county [early voting] clerk may conduct [the
6464 personal appearance] voting of limited ballots by using official
6565 ballots for early voting by mail.
6666 SECTION 6. Section 112.011, Election Code, is amended to
6767 read as follows:
6868 Sec. 112.011. INFORMATION FOR LIMITED BALLOT [ON DISTRICT
6969 COMPOSITION]. [(a)] In each even-numbered year, the secretary of
7070 state shall prepare information on each office and proposition
7171 stating a measure to be voted on statewide [the territorial
7272 composition of each district for which an officer of the state
7373 government is regularly elected at the general election for state
7474 and county officers].
7575 [(b) The information must include the data necessary to
7676 enable an early voting clerk to determine the district offices on
7777 which a voter under this chapter is eligible to vote.
7878 [(c)] The secretary shall deliver the information to each
7979 county clerk at a date early enough to prepare ballots or program
8080 voting machines [before the 20th day before general primary
8181 election day].
8282 SECTION 7. Section 112.012, Election Code, is amended to
8383 read as follows:
8484 Sec. 112.012. NOTIFICATION TO VOTER REGISTRAR. Not later
8585 than the 30th day after receipt of an application for a limited
8686 ballot, the county [early voting] clerk shall notify the voter
8787 registrar for the voter's former county of residence that the voter
8888 has applied for a limited ballot.
8989 SECTION 8. Section 112.008, Election Code, is repealed.
9090 SECTION 9. This Act takes effect September 1, 2017.
