8	8	AN ACT
9	9	relating to authorizing and financing certain sports and community
10	10	venue projects.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 334.001, Local Government Code, is
13	13	amended by amending Subdivisions (1) and (4) and adding Subdivision
14	14	(1-a) to read as follows:
15	15	(1) "Active transportation" means transportation that
16	16	is wholly or primarily powered by human energy. The term includes
17	17	walking, running, and bicycling.
18	18	(1-a) "Approved venue project" means a sports and
19	19	community venue project that has been approved under this chapter
20	20	by the voters of a municipality or county.
21	21	(4) "Venue" means:
22	22	(A) an arena, coliseum, stadium, or other type of
23	23	area or facility:
24	24	(i) that is used or is planned for use for
25	25	one or more professional or amateur sports events, community
26	26	events, or other sports events, including rodeos, livestock shows,
27	27	agricultural expositions, promotional events, and other civic or
28	28	charitable events; and
29	29	(ii) for which a fee for admission to the
30	30	events is charged or is planned to be charged;
31	31	(B) a convention center, convention center
32	32	facility as defined by Section 351.001(2) or 352.001(2), Tax Code,
33	33	or related improvement such as a civic center hotel, theater, opera
34	34	house, music hall, rehearsal hall, park, zoological park, museum,
35	35	aquarium, or plaza located in the vicinity of a convention center or
36	36	facility owned by a municipality or a county;
37	37	(C) a tourist development area [along an inland
38	38	waterway];
39	39	(D) a municipal parks and recreation system, or
40	40	improvements or additions to a parks and recreation system, or an
41	41	area or facility, including an area or facility for active
42	42	transportation use, that is part of a municipal parks and
43	43	recreation system;
44	44	(E) a project authorized by Section 4A or 4B,
45	45	Development Corporation Act of 1979 (Article 5190.6, Vernon's Texas
46	46	Civil Statutes), as that Act existed on September 1, 1997; [and]
47	47	(F) a watershed protection and preservation
48	48	project; a recharge, recharge area, or recharge feature protection
49	49	project; a conservation easement; or an open-space preservation
50	50	program intended to protect water; and
51	51	(G) an airport facility located in a municipality
52	52	located on the international border.
53	53	SECTION 2. Section 334.1015, Local Government Code, is
54	54	amended to read as follows:
55	55	Sec. 334.1015. APPLICATION. (a) Except as provided by
56	56	Subsection (b), this [This] subchapter does not apply to the
57	57	financing of a venue project that is an area or facility that is
58	58	part of a municipal parks and recreation system.
59	59	(b) A municipality located on the international border may
60	60	finance a venue project described by Section 334.001(4)(D) with the
61	61	revenue from a tax imposed under this subchapter.
62	62	SECTION 3. Section 334.2515, Local Government Code, is
63	63	amended to read as follows:
64	64	Sec. 334.2515. APPLICATION. Except as provided by Section
65	65	334.2516, this subchapter does not apply to the financing of a venue
66	66	project that is:
67	67	(1) an area described by Section 334.001(4)(C);
68	68	(2) an area or facility that is part of a municipal
69	69	parks and recreation system as described by Section 334.001(4)(D);
70	70	[or]
71	71	(3) [(2)] a project described by Section
72	72	334.001(4)(E), except for a project [projects] described by [in]
73	73	Section 334.001(4)(A); or
74	74	(4) a facility described by Section 334.001(4)(G).
75	75	SECTION 4. This Act takes effect September 1, 2017.
