6	6	AN ACT
7	7	relating to repayment of money contributed by the Texas Department
8	8	of Transportation or the Texas Transportation Commission for toll
9	9	projects.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 222.103(a), Transportation Code, is
12	12	amended to read as follows:
13	13	(a) The department may participate, by spending money from
14	14	any available source, in the cost of the acquisition, construction,
15	15	maintenance, or operation of a toll facility of a public or private
16	16	entity on terms and conditions established by the commission. The
17	17	commission[:
18	18	[(1) may require the repayment of any money spent by
19	19	the department for the cost of a toll facility of a public entity;
20	20	and
21	21	[(2)] shall require the repayment of any money spent
22	22	[by the department for the cost of a toll facility of a private
23	23	entity].
24	24	SECTION 2. Section 366.301(c), Transportation Code, is
25	25	amended to read as follows:
26	26	(c) An obligation or expense incurred by the commission or
27	27	department under this section is a part of the cost of the turnpike
28	28	project for which the obligation or expense was incurred. The
29	29	commission or department shall [may] require money contributed by
30	30	the commission or department under this section to be repaid. The
31	31	commission or department may require the money to be repaid from
32	32	tolls or other revenue of the turnpike project or system on which
33	33	the money was spent. Money repaid as required by the commission or
34	34	department shall be deposited to the credit of the fund from which
35	35	the contribution was made. Money deposited as required by this
36	36	section is exempt from the application of Section 403.095,
37	37	Government Code.
38	38	SECTION 3. Section 370.033(m), Transportation Code, is
39	39	amended to read as follows:
40	40	(m) If an authority receives money from the general revenue
41	41	fund, the Texas Mobility Fund, or the state highway fund, it:
42	42	(1) may use the money only to acquire, design,
43	43	finance, construct, operate, or maintain a turnpike project under
44	44	Section 370.003(14)(A) or (D) or a transit system under Section
45	45	370.351; and
46	46	(2) must repay the money.
47	47	SECTION 4. Sections 370.301(c) and (f), Transportation
48	48	Code, are amended to read as follows:
49	49	(c) An obligation or expense incurred by the commission or
50	50	department under this section is a part of the cost of the turnpike
51	51	project for which the obligation or expense was incurred. The
52	52	commission or department shall [may] require money contributed by
53	53	the commission or department under this section to be repaid. The
54	54	commission or department may require the money to be repaid from
55	55	tolls or other revenue of the turnpike project on which the money
56	56	was spent. Money repaid as required by the commission or department
57	57	shall be deposited to the credit of the fund from which the
58	58	contribution was made. Money deposited as required by this section
59	59	is exempt from the application of Section 403.095, Government Code.
60	60	(f) The commission may [grant or] loan department money to
61	61	an authority for the acquisition of land for or the construction,
62	62	maintenance, or operation of a turnpike project. The commission
63	63	shall [may] require the authority to repay money loaned [provided]
64	64	under this section. The commission may require the money to be
65	65	repaid from toll revenue or other sources on terms established by
66	66	the commission.
67	67	SECTION 5. Subchapter A, Chapter 372, Transportation Code,
68	68	is amended by adding Section 372.002 to read as follows:
69	69	Sec. 372.002. REPAYMENT OF MONEY CONTRIBUTED BY DEPARTMENT.
70	70	A toll project entity shall repay to the department any money
71	71	contributed by the department as participation in the cost of the
72	72	entity's toll projects, including money from the state highway
73	73	fund, the Texas Mobility Fund, or other sources available to the
74	74	department.
75	75	SECTION 6. The changes in law made by this Act apply only to
76	76	a loan, grant, or other contribution made by the Texas Department of
77	77	Transportation or the Texas Transportation Commission on or after
78	78	the effective date of this Act. A loan, grant, or other
79	79	contribution made before the effective date of this Act is governed
80	80	by the law in effect on the date the loan, grant, or other
81	81	contribution is made, and the former law is continued in effect for
82	82	that purpose.
83	83	SECTION 7. This Act takes effect September 1, 2017.
