55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of groundwater management areas to
88 coincide with major and minor aquifers and the joint planning
99 process in those areas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 35.004(a), Water Code, is amended to
1212 read as follows:
1313 (a) The Texas Water Development Board, with assistance and
1414 cooperation from the commission, shall designate groundwater
1515 management areas so that each major aquifer and each minor aquifer
1616 in this state is assigned to a groundwater management area
1717 designated solely for that aquifer [covering all major and minor
1818 aquifers in the state. The initial designation of groundwater
1919 management areas shall be completed not later than September 1,
2020 2003. Each groundwater management area shall be designated with the
2121 objective of providing the most suitable area for the management of
2222 the groundwater resources. To the extent feasible, the groundwater
2323 management area shall coincide with the boundaries of a groundwater
2424 reservoir or a subdivision of a groundwater reservoir. The Texas
2525 Water Development Board also may consider other factors, including
2626 the boundaries of political subdivisions].
2727 SECTION 2. Sections 36.108(c), (d), and (d-1), Water Code,
2828 are amended to read as follows:
2929 (c) The district representatives shall meet at least
3030 annually to conduct joint planning with the other districts in each
3131 [the] management area to which the district belongs and to review
3232 the management plans, the accomplishments of the management area,
3333 and proposals to adopt new or amend existing desired future
3434 conditions. In reviewing the management plans, the districts
3535 shall consider:
3636 (1) the goals of each management plan and its impact on
3737 planning throughout the management area;
3838 (2) the effectiveness of the measures established by
3939 each district's management plan for conserving and protecting
4040 groundwater and preventing waste, and the effectiveness of these
4141 measures in the management area generally;
4242 (3) any other matters that the boards consider
4343 relevant to the protection and conservation of groundwater and the
4444 prevention of waste in the management area; and
4545 (4) the degree to which each management plan achieves
4646 the desired future conditions established during the joint planning
4747 process.
4848 (d) Not later than August 1, 2020 [September 1, 2010], and
4949 every five years thereafter, the districts shall consider
5050 groundwater availability models and other data or information for
5151 the management area and shall propose for adoption desired future
5252 conditions for the aquifer [relevant aquifers] within the
5353 management area. Before voting on the proposed desired future
5454 conditions of the aquifer [aquifers] under Subsection (d-2), the
5555 districts shall consider:
5656 (1) aquifer uses or conditions within the management
5757 area, including conditions that differ substantially from one
5858 geographic area to another;
5959 (2) the water supply needs and water management
6060 strategies included in the state water plan;
6161 (3) hydrological conditions, including [for each
6262 aquifer in the management area] the total estimated recoverable
6363 storage for the aquifer as provided by the executive administrator,
6464 and the aquifer's average annual recharge, inflows, and discharge;
6565 (4) other environmental impacts, including impacts on
6666 spring flow and other interactions between groundwater and surface
6767 water;
6868 (5) the impact on subsidence;
6969 (6) socioeconomic impacts reasonably expected to
7070 occur;
7171 (7) the impact on the interests and rights in private
7272 property, including ownership and the rights of management area
7373 landowners and their lessees and assigns in groundwater as
7474 recognized under Section 36.002;
7575 (8) the feasibility of achieving the desired future
7676 condition; and
7777 (9) any other information relevant to the specific
7878 desired future conditions.
7979 (d-1) After considering and documenting the factors
8080 described by Subsection (d) and other relevant scientific and
8181 hydrogeological data, the districts may establish different
8282 desired future conditions for:
8383 (1) each [aquifer,] subdivision of an aquifer[,] or
8484 geologic strata located in whole or in part within the area
8585 overlying the aquifer [boundaries of the management area]; or
8686 (2) each geographic area overlying the [an] aquifer
8787 [in whole or in part or subdivision of an aquifer within the
8888 boundaries of the management area].
8989 SECTION 3. Section 36.1085, Water Code, is amended to read
9090 as follows:
9191 Sec. 36.1085. MANAGEMENT PLAN GOALS AND OBJECTIVES. Each
9292 district in the management area shall ensure that its management
9393 plan contains goals and objectives consistent with achieving the
9494 desired future conditions for the aquifer [of the relevant
9595 aquifers] as adopted during the joint planning process.
9696 SECTION 4. Section 35.004(b), Water Code, is repealed.
9797 SECTION 5. Not later than May 1, 2018, the Texas Water
9898 Development Board shall designate groundwater management areas
9999 under Section 35.004, Water Code, as amended by this Act.
100100 SECTION 6. This Act takes effect September 1, 2017.
