55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the explanatory reports issued by the district
88 representatives in groundwater management areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.108(d-3), Water Code, is amended to
1111 read as follows:
1212 (d-3) After the earlier of the date on which all the
1313 districts have submitted their district summaries or the expiration
1414 of the public comment period under Subsection (d-2), the district
1515 representatives shall reconvene to review the reports, consider any
1616 district's suggested revisions to the proposed desired future
1717 conditions, and finally adopt the desired future conditions for the
1818 management area. The desired future conditions must be adopted as a
1919 resolution by a two-thirds vote of all the district
2020 representatives. The district representatives shall produce a
2121 desired future conditions explanatory report for the management
2222 area and submit to the development board and each district in the
2323 management area proof that notice was posted for the joint planning
2424 meeting, a copy of the resolution, and a copy of the explanatory
2525 report. The report must:
2626 (1) identify each desired future condition;
2727 (2) provide the policy and technical justifications
2828 for each desired future condition;
2929 (3) include documentation that the factors under
3030 Subsection (d) were considered by the districts and a discussion of
3131 how the adopted desired future conditions impact each factor;
3232 (4) include an assessment of the brackish groundwater
3333 resources of the management area, categorized by salinity level;
3434 (5) demonstrate that the adopted desired future
3535 condition achieves a balance between the highest practicable level
3636 of groundwater production and the conservation and preservation of
3737 groundwater;
3838 (6) [(4)] list other desired future condition options
3939 considered, if any, and the reasons why those options were not
4040 adopted; and
4141 (7) [(5)] discuss reasons why recommendations made by
4242 advisory committees and relevant public comments received by the
4343 districts were or were not incorporated into the desired future
4444 conditions.
4545 SECTION 2. This Act takes effect September 1, 2017.
