| 12 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 7 | | SECTION 1. Section 321.409(a), Tax Code, is amended to read |
|---|
| 14 | 8 | | as follows: |
|---|
| 15 | 9 | | (a) Notwithstanding any provisions of this code or other |
|---|
| 16 | 10 | | state law, a municipality may by a combined ballot proposition |
|---|
| 17 | 11 | | lower or repeal any [dedicated or special purpose] municipal sales |
|---|
| 18 | 12 | | tax, including the additional sales tax for property tax relief, |
|---|
| 19 | 13 | | and by the same proposition raise or adopt any other [dedicated or |
|---|
| 20 | 14 | | special purpose] municipal sales tax, including the additional |
|---|
| 21 | 15 | | sales tax for property tax relief. |

| 22 | 16 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 17 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 18 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 19 | | Act does not receive the vote necessary for immediate effect, this |

| 26 | 20 | | Act takes effect September 1, 2017. |
