66 AN ACT
77 relating to the new technology implementation grant program
88 administered by the Texas Commission on Environmental Quality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 391.002(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) Projects that may be considered for a grant under the
1313 program include:
1414 (1) advanced clean energy projects, as defined by
1515 Section 382.003;
1616 (2) new technology projects that reduce emissions of
1717 regulated pollutants from stationary [point] sources;
1818 (3) new technology projects that reduce emissions from
1919 upstream and midstream oil and gas production, completion,
2020 gathering, storage, processing, and transmission activities
2121 through:
2222 (A) the replacement, repower, or retrofit of
2323 stationary compressor engines;
2424 (B) the installation of systems to reduce or
2525 eliminate the loss of gas, flaring of gas, or burning of gas using
2626 other combustion control devices; or
2727 (C) the installation of systems that reduce
2828 flaring emissions and other site emissions by capturing waste heat
2929 to generate electricity; and
3030 (4) [(3)] electricity storage projects related to
3131 renewable energy, including projects to store electricity produced
3232 from wind and solar generation that provide efficient means of
3333 making the stored energy available during periods of peak energy
3434 use.
3535 SECTION 2. Section 391.205(a), Health and Safety Code, is
3636 amended to read as follows:
3737 (a) Except as provided by Subsection (c), in awarding grants
3838 under this chapter the commission shall give preference to projects
3939 that:
4040 (1) involve the transport, use, recovery for use, or
4141 prevention of the loss of natural resources originating or produced
4242 in this state;
4343 (2) contain an energy efficiency component; [or]
4444 (3) include the use of solar, wind, or other renewable
4545 energy sources; or
4646 (4) recover waste heat from the combustion of natural
4747 resources and use the heat to generate electricity.
4848 SECTION 3. This Act takes effect September 1, 2017.
