| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter I, Chapter 545, Transportation Code, |
|---|
| 13 | 13 | | is amended by adding Section 545.4141 to read as follows: |
|---|
| 14 | 14 | | Sec. 545.4141. CARRYING PERSON IN TRUNK; OFFENSE. (a) In |
|---|
| 15 | 15 | | this section, "trunk" means that portion of a motor vehicle that is: |
|---|
| 16 | 16 | | (1) designed for the transportation of cargo and not |
|---|
| 17 | 17 | | the transportation of the operator or passengers; and |
|---|
| 18 | 18 | | (2) enclosed on all sides and accessible only by means |
|---|
| 19 | 19 | | of a door or lid. |
|---|
| 20 | 20 | | (b) A person commits an offense if the person operates a |
|---|
| 21 | 21 | | motor vehicle on a highway or street while another person is |
|---|
| 22 | 22 | | occupying the trunk. |
|---|
| 23 | 23 | | (c) An offense under this section is a Class B misdemeanor. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2017. |
