7 | 7 | | relating to bail bond boards in certain counties. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter B, Chapter 1704, Occupations Code, is |
---|
10 | 10 | | amended by adding Section 1704.0531 to read as follows: |
---|
11 | 11 | | Sec. 1704.0531. BOARD COMPOSITION IN CERTAIN COUNTIES. (a) |
---|
12 | 12 | | This section applies only in a county with a population of 700,000 |
---|
13 | 13 | | or more but less than 780,000. |
---|
14 | 14 | | (b) A board in a county described by Subsection (a) consists |
---|
15 | 15 | | of nine members as follows: |
---|
16 | 16 | | (1) a licensed bail bond surety or agent for a |
---|
17 | 17 | | corporate surety in the county; |
---|
18 | 18 | | (2) two criminal defense attorneys practicing in the |
---|
19 | 19 | | county; |
---|
20 | 20 | | (3) the county judge; |
---|
21 | 21 | | (4) the county clerk; |
---|
22 | 22 | | (5) the district clerk; |
---|
23 | 23 | | (6) a justice of the peace; |
---|
24 | 24 | | (7) the sheriff or a designee from the sheriff's |
---|
25 | 25 | | office; and |
---|
26 | 26 | | (8) a judge of a district or county court having |
---|
27 | 27 | | jurisdiction over criminal matters in the county. |
---|
28 | 28 | | (c) The members described by Subsections (b)(1), (2), and |
---|
29 | 29 | | (6) shall be elected as provided by Section 1704.0535. Each judge |
---|
30 | 30 | | of a district or county court having criminal jurisdiction in the |
---|
31 | 31 | | county is entitled to cast one vote at a secret ballot election |
---|
32 | 32 | | conducted by the board annually to elect the board member described |
---|
33 | 33 | | by Subsection (b)(8). |
---|
34 | 34 | | (d) The board shall elect a presiding officer from its |
---|
35 | 35 | | members to serve a one-year term. A member may not serve more than |
---|
36 | 36 | | two consecutive terms as presiding officer. |
---|
37 | 37 | | (e) The provisions of Chapter 551, Government Code, apply to |
---|
38 | 38 | | the board. |
---|
39 | 39 | | (f) The board shall prepare and maintain minutes of each |
---|
40 | 40 | | board meeting. |
---|
41 | 41 | | (g) A board member who has a substantial interest in a |
---|
42 | 42 | | business entity, as determined by Section 171.002, Local Government |
---|
43 | 43 | | Code, must file, before a vote or decision on any matter involving |
---|
44 | 44 | | the business entity, an affidavit stating the nature and extent of |
---|
45 | 45 | | the interest and shall abstain from further participation in the |
---|
46 | 46 | | matter. |
---|
47 | 47 | | SECTION 2. On the effective date of this Act, the term of a |
---|
48 | 48 | | member of an existing bail bond board in a county to which Section |
---|
49 | 49 | | 1704.0531, Occupations Code, as added by this Act, applies, who is |
---|
50 | 50 | | not a member of the board established under that section, is |
---|
51 | 51 | | terminated. |
---|
52 | 52 | | SECTION 3. This Act takes effect September 1, 2017. |
