66 AN ACT
77 relating to bail bond boards in certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 1704, Occupations Code, is
1010 amended by adding Section 1704.0531 to read as follows:
1111 Sec. 1704.0531. BOARD COMPOSITION IN CERTAIN COUNTIES. (a)
1212 This section applies only in a county with a population of 700,000
1313 or more but less than 780,000.
1414 (b) A board in a county described by Subsection (a) consists
1515 of nine members as follows:
1616 (1) a licensed bail bond surety or agent for a
1717 corporate surety in the county;
1818 (2) two criminal defense attorneys practicing in the
1919 county;
2020 (3) the county judge;
2121 (4) the county clerk;
2222 (5) the district clerk;
2323 (6) a justice of the peace;
2424 (7) the sheriff or a designee from the sheriff's
2525 office; and
2626 (8) a judge of a district or county court having
2727 jurisdiction over criminal matters in the county.
2828 (c) The members described by Subsections (b)(1), (2), and
2929 (6) shall be elected as provided by Section 1704.0535. Each judge
3030 of a district or county court having criminal jurisdiction in the
3131 county is entitled to cast one vote at a secret ballot election
3232 conducted by the board annually to elect the board member described
3333 by Subsection (b)(8).
3434 (d) The board shall elect a presiding officer from its
3535 members to serve a one-year term. A member may not serve more than
3636 two consecutive terms as presiding officer.
3737 (e) The provisions of Chapter 551, Government Code, apply to
3838 the board.
3939 (f) The board shall prepare and maintain minutes of each
4040 board meeting.
4141 (g) A board member who has a substantial interest in a
4242 business entity, as determined by Section 171.002, Local Government
4343 Code, must file, before a vote or decision on any matter involving
4444 the business entity, an affidavit stating the nature and extent of
4545 the interest and shall abstain from further participation in the
4646 matter.
4747 SECTION 2. On the effective date of this Act, the term of a
4848 member of an existing bail bond board in a county to which Section
4949 1704.0531, Occupations Code, as added by this Act, applies, who is
5050 not a member of the board established under that section, is
5151 terminated.
5252 SECTION 3. This Act takes effect September 1, 2017.
