55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a municipality or county to impose
88 certain taxes to finance certain venue projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 334.001(4), Local Government Code, is
1111 amended to read as follows:
1212 (4) "Venue" means:
1313 (A) an arena, coliseum, stadium, or other type of
1414 area or facility:
1515 (i) that is used or is planned for use for
1616 one or more professional or amateur sports events, community
1717 events, or other sports events, including rodeos, livestock shows,
1818 agricultural expositions, promotional events, and other civic or
1919 charitable events; and
2020 (ii) for which a fee for admission to the
2121 events is charged or is planned to be charged;
2222 (B) a convention center, convention center
2323 facility as defined by Section 351.001(2) or 352.001(2), Tax Code,
2424 or related improvement such as a civic center hotel, theater, opera
2525 house, music hall, rehearsal hall, park, zoological park, museum,
2626 aquarium, or plaza located in the vicinity of a convention center or
2727 facility owned by a municipality or a county;
2828 (C) a tourist development area along an inland
2929 waterway;
3030 (D) a [municipal] parks and recreation system, or
3131 improvements or additions to a parks and recreation system, or an
3232 area or facility that is part of a [municipal] parks and recreation
3333 system;
3434 (E) a project authorized by Section 4A or 4B,
3535 Development Corporation Act of 1979 (Article 5190.6, Vernon's Texas
3636 Civil Statutes), as that Act existed on September 1, 1997; and
3737 (F) a watershed protection and preservation
3838 project; a recharge, recharge area, or recharge feature protection
3939 project; a conservation easement; or an open-space preservation
4040 program intended to protect water.
4141 SECTION 2. Section 334.024(f), Local Government Code, is
4242 amended to read as follows:
4343 (f) If the venue project is authorized by Section
4444 334.001(4)(D) and the venue project does not include improvements
4545 and/or additions to all parks and/or recreation facilities of the
4646 municipality or county, the description of the venue project in the
4747 proposition, if for improvements or additions to an existing park
4848 or recreation facility, shall identify by name or location each
4949 park or recreation facility and, if for acquisition and/or
5050 improvement of a new park or recreation facility, the general
5151 location within the municipality or county of the new park,
5252 recreational system, or facility.
5353 SECTION 3. Section 334.2515, Local Government Code, is
5454 amended to read as follows:
5555 Sec. 334.2515. APPLICATION. Except as provided by Section
5656 334.2516, this subchapter does not apply to the financing of a venue
5757 project that is[:
5858 [(1) an area or facility that is part of a municipal
5959 parks and recreation system as described by Section 334.001(4)(D);
6060 or
6161 [(2)] a project described by Section 334.001(4)(E),
6262 except for projects described in Section 334.001(4)(A).
6363 SECTION 4. Sections 334.008, 334.1015, and 334.2517, Local
6464 Government Code, are repealed.
6565 SECTION 5. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2017.
