| 7 | 7 | | relating to the authority of a municipality or county to impose |
|---|
| 8 | 8 | | certain taxes to finance certain venue projects. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 334.001(4), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (4) "Venue" means: |
|---|
| 13 | 13 | | (A) an arena, coliseum, stadium, or other type of |
|---|
| 14 | 14 | | area or facility: |
|---|
| 15 | 15 | | (i) that is used or is planned for use for |
|---|
| 16 | 16 | | one or more professional or amateur sports events, community |
|---|
| 17 | 17 | | events, or other sports events, including rodeos, livestock shows, |
|---|
| 18 | 18 | | agricultural expositions, promotional events, and other civic or |
|---|
| 19 | 19 | | charitable events; and |
|---|
| 20 | 20 | | (ii) for which a fee for admission to the |
|---|
| 21 | 21 | | events is charged or is planned to be charged; |
|---|
| 22 | 22 | | (B) a convention center, convention center |
|---|
| 23 | 23 | | facility as defined by Section 351.001(2) or 352.001(2), Tax Code, |
|---|
| 24 | 24 | | or related improvement such as a civic center hotel, theater, opera |
|---|
| 25 | 25 | | house, music hall, rehearsal hall, park, zoological park, museum, |
|---|
| 26 | 26 | | aquarium, or plaza located in the vicinity of a convention center or |
|---|
| 27 | 27 | | facility owned by a municipality or a county; |
|---|
| 28 | 28 | | (C) a tourist development area along an inland |
|---|
| 29 | 29 | | waterway; |
|---|
| 30 | 30 | | (D) a [municipal] parks and recreation system, or |
|---|
| 31 | 31 | | improvements or additions to a parks and recreation system, or an |
|---|
| 32 | 32 | | area or facility that is part of a [municipal] parks and recreation |
|---|
| 33 | 33 | | system; |
|---|
| 34 | 34 | | (E) a project authorized by Section 4A or 4B, |
|---|
| 35 | 35 | | Development Corporation Act of 1979 (Article 5190.6, Vernon's Texas |
|---|
| 36 | 36 | | Civil Statutes), as that Act existed on September 1, 1997; and |
|---|
| 37 | 37 | | (F) a watershed protection and preservation |
|---|
| 38 | 38 | | project; a recharge, recharge area, or recharge feature protection |
|---|
| 39 | 39 | | project; a conservation easement; or an open-space preservation |
|---|
| 40 | 40 | | program intended to protect water. |
|---|
| 41 | 41 | | SECTION 2. Section 334.024(f), Local Government Code, is |
|---|
| 42 | 42 | | amended to read as follows: |
|---|
| 43 | 43 | | (f) If the venue project is authorized by Section |
|---|
| 44 | 44 | | 334.001(4)(D) and the venue project does not include improvements |
|---|
| 45 | 45 | | and/or additions to all parks and/or recreation facilities of the |
|---|
| 46 | 46 | | municipality or county, the description of the venue project in the |
|---|
| 47 | 47 | | proposition, if for improvements or additions to an existing park |
|---|
| 48 | 48 | | or recreation facility, shall identify by name or location each |
|---|
| 49 | 49 | | park or recreation facility and, if for acquisition and/or |
|---|
| 50 | 50 | | improvement of a new park or recreation facility, the general |
|---|
| 51 | 51 | | location within the municipality or county of the new park, |
|---|
| 52 | 52 | | recreational system, or facility. |
|---|
| 53 | 53 | | SECTION 3. Section 334.2515, Local Government Code, is |
|---|
| 54 | 54 | | amended to read as follows: |
|---|
| 55 | 55 | | Sec. 334.2515. APPLICATION. Except as provided by Section |
|---|
| 56 | 56 | | 334.2516, this subchapter does not apply to the financing of a venue |
|---|
| 57 | 57 | | project that is[: |
|---|
| 58 | 58 | | [(1) an area or facility that is part of a municipal |
|---|
| 59 | 59 | | parks and recreation system as described by Section 334.001(4)(D); |
|---|
| 60 | 60 | | or |
|---|
| 61 | 61 | | [(2)] a project described by Section 334.001(4)(E), |
|---|
| 62 | 62 | | except for projects described in Section 334.001(4)(A). |
|---|
| 63 | 63 | | SECTION 4. Sections 334.008, 334.1015, and 334.2517, Local |
|---|
| 64 | 64 | | Government Code, are repealed. |
|---|
| 65 | 65 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 66 | 66 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 67 | 67 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 68 | 68 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 69 | 69 | | Act takes effect September 1, 2017. |
