115 relating to the definitions of highway maintenance and service
126 vehicles for purposes of certain provisions governing vehicle
137 equipment.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 547.001, Transportation Code, is amended
1610 by adding Subdivisions (2-b) and (6-a) to read as follows:
1711 (2-b) "Highway maintenance vehicle" means a highway or
1812 traffic maintenance vehicle designated by the Texas Department of
1913 Transportation. The term includes equipment for:
2014 (A) road maintenance, including:
2115 (i) equipment for snow removal, line
2216 striping, skid resistance testing, sweeping, and spraying;
2317 (ii) aerial platform lift machines; and
2418 (iii) road profiler machines; and
2519 (B) off-road use, including motor graders, road
2620 rollers, excavators, pneumatic tire equipment, movers, and
2721 tractors.
2822 (6-a) "Service vehicle" means a highway or traffic
2923 maintenance vehicle that:
3024 (A) is owned and operated on a highway by or for a
3125 governmental agency and performs a function requiring the use of a
3226 lamp or illuminating device in accordance with the standards and
3327 specifications adopted under Section 547.105; or
3428 (B) has a public service function, including
3529 public utility vehicles, tow trucks, and any vehicle designated as
3630 a service vehicle by the Texas Department of Transportation or as an
3731 escort flag vehicle under Section 623.099.
3832 SECTION 2. The heading to Section 547.105, Transportation
3933 Code, is amended to read as follows:
4034 Sec. 547.105. MAINTENANCE AND SERVICE VEHICLE [EQUIPMENT]
4135 LIGHTING STANDARDS.
4236 SECTION 3. Sections 547.105(a) and (b), Transportation
4337 Code, are amended to read as follows:
4438 (a) The Texas Department of Transportation shall adopt
4539 standards and specifications that:
4640 (1) apply to lamps on highway maintenance and service
4741 vehicles [equipment, including snow-removal equipment]; and
4842 (2) correlate with and conform as closely as possible
4943 to standards and specifications approved by the American
5044 Association of State Highway and Transportation Officials.
5145 (b) The Texas Department of Transportation may adopt
5246 standards and specifications for lighting that permit the use of
5347 flashing lights for identification purposes on highway maintenance
5448 and service vehicles [equipment, including snow-removal
5549 equipment].
5650 SECTION 4. Section 547.305(e), Transportation Code, is
5751 amended to read as follows:
5852 (e) A person may not operate a highway maintenance or
5953 service vehicle [equipment, including snow-removal equipment,]
6054 that is not equipped with lamps or that does not display lighted
6155 lamps as required by the standards and specifications adopted by
6256 the Texas Department of Transportation.
6357 SECTION 5. This Act takes effect September 1, 2017.
