10	4		AN ACT
11	5		relating to the definitions of highway maintenance and service
12	6		vehicles for purposes of certain provisions governing vehicle
13	7		equipment.
14	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	9		SECTION 1. Section 547.001, Transportation Code, is amended
16	10		by adding Subdivisions (2-b) and (6-a) to read as follows:
17	11		(2-b) "Highway maintenance vehicle" means a highway or
18	12		traffic maintenance vehicle designated by the Texas Department of
19	13		Transportation. The term includes equipment for:
20	14		(A) road maintenance, including:
21	15		(i) equipment for snow removal, line
22	16		striping, skid resistance testing, sweeping, and spraying;
23	17		(ii) aerial platform lift machines; and
24	18		(iii) road profiler machines; and
25	19		(B) off-road use, including motor graders, road
26	20		rollers, excavators, pneumatic tire equipment, movers, and
27	21		tractors.
28	22		(6-a) "Service vehicle" means a highway or traffic
29	23		maintenance vehicle that:
30	24		(A) is owned and operated on a highway by or for a
31	25		governmental agency and performs a function requiring the use of a
32	26		lamp or illuminating device in accordance with the standards and
33	27		specifications adopted under Section 547.105; or
34	28		(B) has a public service function, including
35	29		public utility vehicles, tow trucks, and any vehicle designated as
36	30		a service vehicle by the Texas Department of Transportation or as an
37	31		escort flag vehicle under Section 623.099.
38	32		SECTION 2. The heading to Section 547.105, Transportation
39	33		Code, is amended to read as follows:
40	34		Sec. 547.105. MAINTENANCE AND SERVICE VEHICLE [EQUIPMENT]
41	35		LIGHTING STANDARDS.
42	36		SECTION 3. Sections 547.105(a) and (b), Transportation
43	37		Code, are amended to read as follows:
44	38		(a) The Texas Department of Transportation shall adopt
45	39		standards and specifications that:
46	40		(1) apply to lamps on highway maintenance and service
47	41		vehicles [equipment, including snow-removal equipment]; and
48	42		(2) correlate with and conform as closely as possible
49	43		to standards and specifications approved by the American
50	44		Association of State Highway and Transportation Officials.
51	45		(b) The Texas Department of Transportation may adopt
52	46		standards and specifications for lighting that permit the use of
53	47		flashing lights for identification purposes on highway maintenance
54	48		and service vehicles [equipment, including snow-removal
55	49		equipment].
56	50		SECTION 4. Section 547.305(e), Transportation Code, is
57	51		amended to read as follows:
58	52		(e) A person may not operate a highway maintenance or
59	53		service vehicle [equipment, including snow-removal equipment,]
60	54		that is not equipped with lamps or that does not display lighted
61	55		lamps as required by the standards and specifications adopted by
62	56		the Texas Department of Transportation.
63	57		SECTION 5. This Act takes effect September 1, 2017.
