55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to evaluating and improving the provision of prevention
88 and early intervention services by the Department of Family and
99 Protective Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 265, Family Code, is
1212 amended by adding Sections 265.007 and 265.008 to read as follows:
1313 Sec. 265.007. IMPROVING PROVISION OF PREVENTION AND EARLY
1414 INTERVENTION SERVICES. To improve the effectiveness and delivery
1515 of prevention and early intervention services, the department
1616 shall:
1717 (1) use a geographic focus to ensure that prevention
1818 and early intervention services are provided to families with the
1919 greatest need;
2020 (2) identify the geographic areas that have the
2121 highest need for prevention and early intervention services using:
2222 (A) verified external risk terrain modeling; or
2323 (B) geographic risk assessments that use risk
2424 indicators of child abuse or neglect and child abuse fatalities;
2525 (3) identify geographic areas that have a high need
2626 for prevention and early intervention services but do not have
2727 prevention and early intervention services available in the area or
2828 have only unevaluated prevention and early intervention services
2929 available in the area; and
3030 (4) develop strategies for community partners to:
3131 (A) improve the early recognition of child abuse
3232 or neglect;
3333 (B) improve the reporting of child abuse and
3434 neglect; and
3535 (C) prevent child fatalities.
3636 Sec. 265.008. EVALUATION OF PREVENTION AND EARLY
3737 INTERVENTION SERVICES. (a) The department and the Texas Higher
3838 Education Coordinating Board shall enter into agreements with
3939 institutions of higher education to conduct efficacy reviews of any
4040 prevention and early intervention services provided under this
4141 chapter that have not previously been evaluated for effectiveness
4242 in a research evaluation that meets the standards described by
4343 Subsection (b). The efficacy review shall include, when possible, a
4444 cost-benefit analysis of the program to the state.
4545 (b) A prevention and early intervention services program is
4646 considered to have been previously evaluated if it has been
4747 evaluated by at least one rigorous randomized controlled research
4848 trial across heterogeneous populations or communities, the results
4949 of at least one of which have been published in a peer-reviewed
5050 journal.
5151 (c) The department is not required to enter into an
5252 agreement to conduct a program efficacy evaluation under this
5353 section unless:
5454 (1) the department is specifically appropriated money
5555 for the purposes of this section; or
5656 (2) the agreement with the institution of higher
5757 education is cost neutral.
5858 SECTION 2. This Act takes effect September 1, 2017.
