66 AN ACT
77 relating to health care information provided by certain
88 freestanding emergency medical care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 241.252, Health and Safety Code, is
1111 amended by amending Subsection (b) and adding Subsection (b-1) to
1212 read as follows:
1313 (b) A facility described by Section 241.251 shall post
1414 notice that states:
1515 (1) that the facility is a freestanding emergency
1616 medical care facility and not an urgent care center;
1717 (2) that the facility charges rates comparable to a
1818 hospital emergency room [and may charge a facility fee];
1919 (3) [that a facility or a physician providing medical
2020 care at the facility may not be a participating provider in the
2121 patient's health benefit plan provider network; and
2222 [(4)] that a physician providing medical care at the
2323 facility may bill separately from the facility for the medical care
2424 provided to a patient;
2525 (4) any facility fee charged by the facility,
2626 including the minimum and maximum facility fee amounts charged per
2727 visit; and
2828 (5) either:
2929 (A) that the facility does not participate in a
3030 provider network; or
3131 (B) that the facility participates in a provider
3232 network.
3333 (b-1) The notice required under Subsection (b)(5)(B) must:
3434 (1) identify the provider network;
3535 (2) identify each physician providing medical care at
3636 the facility who is excluded from the provider network; and
3737 (3) for each physician described by Subdivision (2):
3838 (A) state that the physician may bill separately
3939 from the facility for the medical care provided to a patient; and
4040 (B) provide the minimum and maximum amounts the
4141 physician charges for each patient visit.
4242 SECTION 2. Section 254.155, Health and Safety Code, is
4343 amended by amending Subsection (a) and adding Subsection (a-1) to
4444 read as follows:
4545 (a) A facility shall post notice that states:
4646 (1) that the facility is a freestanding emergency
4747 medical care facility and not an urgent care center;
4848 (2) that the facility charges rates comparable to a
4949 hospital emergency room [and may charge a facility fee];
5050 (3) [that a facility or a physician providing medical
5151 care at the facility may not be a participating provider in the
5252 patient's health benefit plan provider network; and
5353 [(4)] that a physician providing medical care at the
5454 facility may bill separately from the facility for the medical care
5555 provided to a patient;
5656 (4) any facility fee charged by the facility,
5757 including the minimum and maximum facility fee amounts charged per
5858 visit; and
5959 (5) either:
6060 (A) that the facility does not participate in a
6161 provider network; or
6262 (B) that the facility participates in a provider
6363 network.
6464 (a-1) The notice required under Subsection (a)(5)(B) must:
6565 (1) identify the provider network;
6666 (2) identify each physician providing medical care at
6767 the facility who is excluded from the provider network; and
6868 (3) for each physician described by Subdivision (2):
6969 (A) state that the physician may bill separately
7070 from the facility for the medical care provided to a patient; and
7171 (B) provide the minimum and maximum amounts the
7272 physician charges for each patient visit.
7373 SECTION 3. Notwithstanding Sections 241.252 and 254.155,
7474 Health and Safety Code, as amended by this Act, a freestanding
7575 emergency medical care facility is not required to comply with
7676 those provisions until January 1, 2018.
7777 SECTION 4. This Act takes effect September 1, 2017.
