| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 145.036(d), Election Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (d) For the purpose of filling a vacancy, a majority of the |
|---|
| 15 | 15 | | committee's membership constitutes a quorum. To be nominated, a |
|---|
| 16 | 16 | | person must receive a favorable vote of a majority of the members |
|---|
| 17 | 17 | | voting [present]. |
|---|
| 18 | 18 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 19 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 22 | | Act takes effect September 1, 2017. |
