A BILL TO BE ENTITLED
AN ACT
relating to public education and public school finance matters.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 42.151(b), Education Code, is amended to
read as follows:
(b) A special instructional arrangement for students with
disabilities residing in care and treatment facilities, other than
state schools, whose parents or guardians do not reside in the
district providing education services shall be established under
the rules of the State Board of Education. The funding weight for
this arrangement shall be 5.0 [4.0] for those students who receive
their education service on a local school district campus. A
special instructional arrangement for students with disabilities
residing in state schools shall be established under the rules of
the State Board of Education with a funding weight of 2.8.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
