| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 42.151(b), Education Code, is amended to | |
| 9 | 9 | read as follows: | |
| 10 | 10 | (b) A special instructional arrangement for students with | |
| 11 | 11 | disabilities residing in care and treatment facilities, other than | |
| 12 | 12 | state schools, whose parents or guardians do not reside in the | |
| 13 | 13 | district providing education services shall be established under | |
| 14 | 14 | the rules of the State Board of Education. The funding weight for | |
| 15 | 15 | this arrangement shall be 5.0 [4.0] for those students who receive | |
| 16 | 16 | their education service on a local school district campus. A | |
| 17 | 17 | special instructional arrangement for students with disabilities | |
| 18 | 18 | residing in state schools shall be established under the rules of | |
| 19 | 19 | the State Board of Education with a funding weight of 2.8. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2017. |
