55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain agreements by architects and engineers in or in
88 connection with certain construction contracts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.002(b), Civil Practice and Remedies
1111 Code, is amended to read as follows:
1212 (b) A covenant or promise in, in connection with, or
1313 collateral to a construction contract other than a contract for a
1414 single family or multifamily residence is void and unenforceable if
1515 the covenant or promise provides for a registered architect or
1616 licensed engineer whose engineering or architectural design
1717 services are the subject of the construction contract to defend,
1818 indemnify, or hold harmless an owner or owner's agent or employee
1919 from liability for damage that is caused by or results from the
2020 negligence of a person other than the architect or engineer [an
2121 owner or an owner's agent or employee].
2222 SECTION 2. The change in law made by this Act applies only
2323 to a covenant or promise in, in connection with, or collateral to a
2424 construction contract entered into on or after the effective date
2525 of this Act. A covenant or promise in, in connection with, or
2626 collateral to a construction contract entered into before the
2727 effective date of this Act is governed by the law applicable to the
2828 covenant or promise immediately before the effective date of this
2929 Act, and that law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2017.
