66 AN ACT
77 relating to medical gas and vacuum piping systems testing in
88 certain health facilities and voluntary tester registry.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 222, Health and Safety
1111 Code, is amended by adding Section 222.0055 to read as follows:
1212 Sec. 222.0055. TESTING OF MEDICAL GAS AND VACUUM PIPING
1313 SYSTEM. (a) In this section, "health facility" has the meaning
1414 assigned by Section 221.003.
1515 (b) The executive commissioner and the Texas State Board of
1616 Plumbing Examiners shall jointly adopt rules consistent with
1717 plumbing industry standards related to verification of the
1818 integrity and content of a medical gas and vacuum piping system
1919 installed in a health facility.
2020 SECTION 2. Section 1301.058, Occupations Code, is amended
2121 to read as follows:
2222 Sec. 1301.058. TESTING OF MEDICAL GAS AND VACUUM PIPING;
2323 RULES; REGISTRY. (a) A person is not required to be licensed under
2424 this chapter to verify medical gas and vacuum piping integrity and
2525 content.
2626 (b) The board and the executive commissioner of the Health
2727 and Human Services Commission shall jointly adopt rules consistent
2828 with plumbing industry standards related to verification of the
2929 integrity and content of a medical gas and vacuum piping system
3030 installed in a health facility, as required under Section 222.0055,
3131 Health and Safety Code.
3232 (c) The board by rule shall create and maintain a voluntary
3333 registry of persons who are qualified to verify medical gas and
3434 vacuum piping integrity and content.
3535 SECTION 3. (a) Not later than January 1, 2018, the executive
3636 commissioner of the Health and Human Services Commission and the
3737 Texas State Board of Plumbing Examiners shall jointly adopt rules
3838 required under Section 222.0055, Health and Safety Code, as added
3939 by this Act. Rules adopted by the commission that are in effect on
4040 the effective date of this Act continue in effect until superseded
4141 by joint rules adopted as required by this Act.
4242 (b) Not later than January 1, 2018, the Texas State Board of
4343 Plumbing Examiners shall create the voluntary registry required
4444 under Section 1301.058, Occupations Code, as amended by this Act.
4545 SECTION 4. This Act takes effect September 1, 2017.
