| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 222, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 222.0055 to read as follows: |
|---|
| 12 | 12 | | Sec. 222.0055. TESTING OF MEDICAL GAS AND VACUUM PIPING |
|---|
| 13 | 13 | | SYSTEM. (a) In this section, "health facility" has the meaning |
|---|
| 14 | 14 | | assigned by Section 221.003. |
|---|
| 15 | 15 | | (b) The executive commissioner and the Texas State Board of |
|---|
| 16 | 16 | | Plumbing Examiners shall jointly adopt rules consistent with |
|---|
| 17 | 17 | | plumbing industry standards related to verification of the |
|---|
| 18 | 18 | | integrity and content of a medical gas and vacuum piping system |
|---|
| 19 | 19 | | installed in a health facility. |
|---|
| 20 | 20 | | SECTION 2. Section 1301.058, Occupations Code, is amended |
|---|
| 21 | 21 | | to read as follows: |
|---|
| 22 | 22 | | Sec. 1301.058. TESTING OF MEDICAL GAS AND VACUUM PIPING; |
|---|
| 23 | 23 | | RULES; REGISTRY. (a) A person is not required to be licensed under |
|---|
| 24 | 24 | | this chapter to verify medical gas and vacuum piping integrity and |
|---|
| 25 | 25 | | content. |
|---|
| 26 | 26 | | (b) The board and the executive commissioner of the Health |
|---|
| 27 | 27 | | and Human Services Commission shall jointly adopt rules consistent |
|---|
| 28 | 28 | | with plumbing industry standards related to verification of the |
|---|
| 29 | 29 | | integrity and content of a medical gas and vacuum piping system |
|---|
| 30 | 30 | | installed in a health facility, as required under Section 222.0055, |
|---|
| 31 | 31 | | Health and Safety Code. |
|---|
| 32 | 32 | | (c) The board by rule shall create and maintain a voluntary |
|---|
| 33 | 33 | | registry of persons who are qualified to verify medical gas and |
|---|
| 34 | 34 | | vacuum piping integrity and content. |
|---|
| 35 | 35 | | SECTION 3. (a) Not later than January 1, 2018, the executive |
|---|
| 36 | 36 | | commissioner of the Health and Human Services Commission and the |
|---|
| 37 | 37 | | Texas State Board of Plumbing Examiners shall jointly adopt rules |
|---|
| 38 | 38 | | required under Section 222.0055, Health and Safety Code, as added |
|---|
| 39 | 39 | | by this Act. Rules adopted by the commission that are in effect on |
|---|
| 40 | 40 | | the effective date of this Act continue in effect until superseded |
|---|
| 41 | 41 | | by joint rules adopted as required by this Act. |
|---|
| 42 | 42 | | (b) Not later than January 1, 2018, the Texas State Board of |
|---|
| 43 | 43 | | Plumbing Examiners shall create the voluntary registry required |
|---|
| 44 | 44 | | under Section 1301.058, Occupations Code, as amended by this Act. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2017. |
