| 7 | 7 | | relating to the development of healthy nutrition and physical |

| 8 | 8 | | activity guidelines for public school teachers, public school |
|---|
| 9 | 9 | | administrators, and licensed child-care providers. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 114, Health and Safety Code, is amended |
|---|
| 12 | 12 | | by adding Section 114.009 to read as follows: |
|---|
| 13 | 13 | | Sec. 114.009. NUTRITION AND PHYSICAL ACTIVITY GUIDELINES |
|---|
| 14 | 14 | | FOR CERTAIN EDUCATORS AND CHILD-CARE PROVIDERS. (a) The council |
|---|
| 15 | 15 | | shall develop wellness guidelines to educate public school |
|---|
| 16 | 16 | | teachers, public school administrators, and licensed child-care |
|---|
| 17 | 17 | | providers about serving as role models for children by: |
|---|
| 18 | 18 | | (1) practicing healthy nutrition; and |
|---|
| 19 | 19 | | (2) engaging in physical activity. |
|---|
| 20 | 20 | | (b) The council shall develop incentives to encourage |
|---|
| 21 | 21 | | public school teachers, public school administrators, and licensed |
|---|
| 22 | 22 | | child-care providers to follow the guidelines. |
|---|
| 23 | 23 | | (c) The council shall communicate the guidelines and |
|---|
| 24 | 24 | | incentives to public school teachers, public school |
|---|
| 25 | 25 | | administrators, and licensed child-care providers in this state in |
|---|
| 26 | 26 | | a manner that the council determines is appropriate. |
|---|
| 27 | 27 | | SECTION 2. The interagency obesity council shall develop |
|---|
| 28 | 28 | | the guidelines and incentives required by Sections 114.009(a) and |
|---|
| 29 | 29 | | (b), Health and Safety Code, as added by this Act, not later than |
|---|
| 30 | 30 | | January 1, 2018. The council shall communicate the guidelines and |
|---|
| 31 | 31 | | incentives as required by Section 114.009(c), Health and Safety |
|---|
| 32 | 32 | | Code, as added by this Act, not later than July 1, 2018. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2017. |
